By the Year 2020, Officials and Public Employees' Salaries Will Be Paid Based on Job Positions

Draft Law on amendments and supplements to the Law on Officials and the Law on Public Employees is expected to take effect from January 1, 2020. This law has changed many regulations related to job positions, classification, evaluation, as well as remuneration for officials and public employees.

According to the directives outlined in Resolution 27-NQ/TW on wage reform policies, in the public sector, the State will pay salaries to officials, public employees, and armed forces based on job positions, titles, and leadership roles, consistent with the State's resources and public service revenue sources, ensuring a reasonable correlation with salaries in the labor market.

The objective from 2018 to 2020 is to complete the development and promulgation of new wage policies following wage policy reform content, linked with the roadmap for administrative reform and staff streamlining; renewal and organization of the political system's apparatus; and renovation of public service providers according to the Central Committee's Resolution.

Following the directives outlined in this Resolution and Plan 10-KH/TW on implementing the Resolution of the seventh meeting, the Draft Law amending and supplementing the Law on Officials and the Law on Public Employees clearly defines job positions as the basis for determining staffing, recruitment, utilization, and salary payments for officials and public employees.

To be specific:, for officials, the Draft stipulates:

- Promotion must be based on job positions, consistent with the structure of officials' ranks in the agency, organization, or unit;- Evaluation of task performance must be linked with job positions, reflected through specific tasks and products;- The form, content, and recruitment of officials must be suitable for job position requirements in each sector, ensuring the selection of persons with qualities, qualifications, and capabilities. Persons accepted as officials must meet all the job position requirements.

The Draft also stipulates that the evaluation of task performance of public employees must be linked with job positions, reflected through specific tasks and products.

Additionally, the Draft also amends and supplements several regulations in the Law on Officials 2008 and the Law on Public Employees 2010 such as disciplinary actions against officials; cases in which public employees are granted indefinite-term contracts;...
