Birth Registration for a Child with Only a Father or Mother

Hello Law Clerk,My name is Nguyen Thi T. Currently, I have an issue and hope that the Law Clerk can assist me. Specifically, I have just given birth and wish to register the birth for my child. However, since the father of the child has left, can I register the birth on my own and what are the procedures? Both the child's father and I are Vietnamese.Thank you.

Section 1, Chapter 2 of the Civil Status Law 2014 stipulates birth registration as follows:

In cases where a child has only a father or mother, the People's Committee at the commune level where the father or mother resides has the authority to carry out the birth registration.

Within 60 days from the date of birth, the father or mother is responsible for registering the birth of the child; if the father or mother is unable to register the birth, the paternal or maternal grandparents, other relatives, or individuals and organizations currently raising the child are responsible for registering the birth of the child.

Procedure for birth registration:

- The person registering the birth must submit a completed form as prescribed and the birth certificate issued by the civil status registration authority. In the absence of a birth certificate, a written confirmation from a witness about the birth must be submitted; if there is no witness, an affidavit regarding the birth must be provided; in the case of registering the birth of an abandoned child, a record confirming the abandonment by a competent authority must be included; in the case of registering the birth of a child born via surrogacy, a document proving the surrogacy according to the law is required.- Immediately after receiving all the above documents, if the birth information is complete and accurate, the civil status officer will record the birth details as prescribed in the Civil Status Book; update it into the electronic civil status database, and the national population database to obtain the personal identification number.

The civil status officer and the person registering the birth will sign the Civil Status Book. The President of the People's Committee at the commune level will issue a Birth Certificate to the person being registered.

Therefore, you can fully register the birth of your child at the People's Committee at the commune level where you reside following the above procedures.
