Be Cautious When the Purchase and Sale Control Slip for Toxic Chemicals Lacks Confirmation

This content is addressed by the Government of Vietnam in Decree 71/2019/ND-CP regulating administrative penalties in the field of chemicals and industrial explosives.

Currently, the purchase control slip for toxic chemicals is a document with the confirmation of the buyer and the seller, serving as a basis for controlling the circulation of toxic chemicals in the market according to the provisions of the Law on Chemicals in Vietnam.

The Law on Chemicals clearly states that the control of the purchase and sale of toxic chemicals must have a purchase control slip for toxic chemicals, confirmed by both the buyer and the seller, to serve as a basis for controlling the circulation of toxic chemicals in the market.

According to Decree 71/2019/ND-CP, a fine ranging from VND 100,000 to VND 300,000 is imposed for any of the following violations:

- The purchase control slip for toxic chemicals is not confirmed by either the buyer or the seller;- Each purchase control slip for toxic chemicals does not have complete information as required: name of the chemical, quantity of the chemical, purpose of use; name and signature of the buyer or seller; address, ID number of the representative of the buyer or seller; delivery date.

Note: According to the Law on Chemicals 2007, toxic chemicals are hazardous chemicals that possess at least one of the following hazardous characteristics:

- Acute toxicity;- Chronic toxicity;- Irritation to humans;- Carcinogenic or potentially carcinogenic;- Mutagenic;- Reproductive toxicity;- Bioaccumulation;- Persistent organic pollutants;- Harmful to the environment.

In addition, Clauses 2 and 3 of Article 21 of Decree 71/2019/ND-CP also stipulate penalties for violations related to the regulations on the purchase control slip for toxic chemicals as follows:

- A fine ranging from VND 300,000 to VND 500,000 for the act of not retaining each purchase control slip for toxic chemicals as required for toxic chemicals;- A fine ranging from VND 500,000 to VND 1,000,000 for the act of buying or selling toxic chemicals without a purchase control slip for toxic chemicals.
