The Law on Road Traffic Order and Safety 2024 stipulates the basis for stopping vehicles joining in road traffic for inspection in Vietnam from January 01, 2025 as follows:

On June 27, 2024, the National Assembly of Vietnam approved the Law on Order and Road Traffic Safety 2024.

Basis for stopping vehicles joining in road traffic for inspection in Vietnam from January 01, 2025

According to Article 66 of the Law on Order and Road Traffic Safety 2024, traffic police are permitted to stop vehicles joining in road traffic for inspection upon having one of the following bases:

- When identifying a law violation or having grounds to determine a law violation concerning road traffic order and safety or other legal violations;

- Following the order, patrol, and control plan by an authorized level to discover law violations concerning road traffic order and safety that require stopping the vehicle for inspection to uncover;

- Serving the protection of national security, ensuring social order and safety, and fighting against crime; disaster prevention; fire prevention and fighting, and rescue; disease prevention;

- Having denunciations, flags, reflections, recommendations, or proposals from agencies, organizations, or individuals regarding crimes or other legal violations.

Currently, according to Clause 1 Article 16 of Circular 32/2023/TT-BCA, traffic police officers performing patrol, and control tasks according to a plan can stop traffic vehicles for inspection in the following cases:

- Directly detecting or through professional technical means and equipment discovering, collecting illegal acts regarding road traffic and other legal violations;

- Executing orders, plans for general vehicle control to ensure road traffic order and safety, social order; patrol, control, and thematic violation handling plans ensuring road traffic order, social order issued by an authorized level;

- Having written proposals from the Heads or Deputy Heads of the investigating agencies; written proposals from relevant functional agencies about stopping traffic vehicles for inspection to ensure security, order; fight against crime; prevent disasters, fires; prevent disease; rescue and other illegal acts. The written proposals must specify the time, route, stopped traffic vehicles for inspection, and coordinating forces involved;

- Having denunciations, reflections, recommendations, or reports from organizations or individuals regarding illegal acts by road traffic participants.

Measures for detecting violations of law on road traffic order and safety in Vietnam from January 01, 2025

Article 67 of the Law on Order and Road Traffic Safety 2024 outlines the measures to detect law violations on road traffic order and safety in Vietnam, including:

- Operating and using security surveillance systems to ensure road traffic order and safety; camera systems on traffic routes, in urban areas; works, technical facilities for vehicle load control.

- Using professional technical means and equipment, intelligent devices, and supports for commanding, controlling road traffic.

- Exploiting data from journey monitoring devices, driver image recording devices; receiving data collected from vehicle load control works.

- Exploiting and using information in the Road Traffic Order and Safety Database.

- Observing, inspecting, and directly controlling and comparing by law enforcement officers.

- Receiving, processing reports, reflections, recommendations, proposals, and data collected from means and technical devices by agencies, organizations, individuals according to regulations of the Government of Vietnam.

- Other measures as prescribed by law.

More details can be found in Law on Order and Road Traffic Safety 2024, which comes into force in Vietnam from January 01, 2025, except for cases stated in Clause 2, Article 88 of the Law on Order and Road Traffic Safety 2024.

The Law on Road Traffic 2008, amended and supplemented by certain provisions of the Law Amending and Supplementing Certain Laws Concerning Planning 2018 and the Law on Prevention and Control of Harmful Effects of Alcohol 2019, will be void since the effective date of the Law on Order and Road Traffic Safety 2024, except for cases stated in Clauses 1, 2, 5, and 6, Article 89 of the Law on Order and Road Traffic Safety 2024.
