Recently, the Ministry of Transport issued Circular 85/2015/TT-BGTVT regulating responsibilities and handling violations in aviation transport operations.
Who has the authority to handle violations in air transport activities (Illustrative Image)
Circular 85/2015/TT-BGTVT stipulates the competent authority to handle violations in air transport activities as follows:
- The Minister of Transport decides on the handling of violations against the Director General of the Civil Aviation Authority of Vietnam and other subjects under its jurisdiction.
- The Director General of the Civil Aviation Authority of Vietnam:
- Decides on the handling of violations against the Director of the Airport Authority and other subjects under its jurisdiction;- Issues warnings, notifications or requests in accordance with this Circular;- Issues and revokes the list stipulated in Clause 2, Article 15 of this Circular;
- The Director of the Airport Authority:
- Decides on the handling of violations against individuals under the Airport Authority and other subjects under its jurisdiction;- Issues warnings in accordance with this Circular.
- Heads of inspection teams or authorized individuals must promptly report in writing about the violations of organizations and individuals to the competent authority for handling in accordance with the provisions of law.
- The head or legal representative of the organization handles violations of individuals within the organization in accordance with the law and organizational regulations.
Note: Depending on the subject and extent of the violation, officials and public employees will be reviewed and disciplined in accordance with the laws on officials and public employees.
