On October 18, 2024, the Minister of Culture, Sports, and Tourism of Vietnam issued Circular 08/2024/TT-BVHTTDL, regulating the organization and activities of the Arts Council in the field of performing arts in Vietnam.

Authority to establish the Arts Council in the field of performing arts in Vietnam from December 10, 2024

According to Article 2 of Circular 08/2024/TT-BVHTTDL, the authority to establish, the composition, structure, and term of the Arts Council in the field of performing arts in Vietnam are stipulated as follows:

(1) Authority to establish the Council

- The Council of the Ministry of Culture, Sports, and Tourism is established by the decision of the Minister of Culture, Sports, and Tourism; with a minimum number of 07 (seven) members or more;

- The Council of the province or centrally affiliated city is established by the decision of the Chairman of the Provincial People's Committee or centrally affiliated city; with a minimum number of 07 (seven) members or more.

(2) The composition of the Council includes representatives who are leaders of state agencies, managers, and experts with prestige and experience in the field of performing arts.

(3) The authorized individual to establish the Council, as specified in item (1), can decide to dismiss, supplement or replace members of the Council under the following cases:

- A member submits a request to withdraw from the Council;

- A member violates the Council's working principles, does not fulfill the responsibilities of a Council member as stipulated in Article 4 and Article 5 of Circular 08/2024/TT-BVHTTDL.

- A member is absent for more than 03 (three) consecutive working sessions without a valid reason.

(4) The structure of the Council includes a Chairperson, Vice-Chairperson, and members. The total number of Council members is odd. The Council includes a Secretariat to assist, decided by the authority establishing the Council, with a minimum of 02 (two) members or more.

(5) The Council operates on a term basis, with a minimum duration of 03 (three) years. If necessary, a council may be established to perform specific tasks.

(6) The authorized state agency as specified in this Circular is the Ministry of Culture, Sports, and Tourism and the Provincial People's Committee or centrally affiliated city.

(7) In cases where artistic performances involve complexities, requiring the coordination of various sectors or fields, the Chairperson of the Council (or the authorized Vice-Chairperson) may propose to the authority establishing the Council to invite additional experts for advisory opinions to the competent state agency.

Functions and duties of the Arts Council in the field of performing arts in Vietnam from December 10, 2024

The Arts Council in the field of performing arts in Vietnam is specified in Article 3 of Circular 08/2024/TT-BVHTTDL as follows:

- Functions of the Council

To provide advisory functions to the competent state agency on artistic performance activities.

- Duties of the Council

+ To analyze, evaluate, and assess artistic performance activities utilizing state budget funds when proposed by the head of the competent state agency as per the legal provisions;

+ To analyze, evaluate, and assess artistic performance activities at the request of the head of the competent state agency managing performing arts activities as stipulated in Decree 144/2020/ND-CP.
