Authority to Establish Administrative Penalty Records in the Maritime Zones, Islands, and Continental Shelf of Vietnam

For actions violating the laws on Vietnamese seas, islands, and continental shelf, the individuals authorized to issue administrative violation records include:

1. Positions authorized to impose administrative penalties and make records of administrative violations within their respective areas of management:

- Vietnam Coast Guard;- Border Defense Force;- Customs;- Maritime Inspectorate, Maritime Administration, Director General of Vietnam Maritime Administration; Head of Specialized Inspection Team, Chief Inspector of the Ministry of Transport;- Market Management;- Chairman of the People's Committee;- Fisheries Surveillance;

2. Coast Guard officers, Border Defense Force officers, make records of all administrative violations in the seas, islands, and continental shelf of Vietnam.

3. Inspectors of the Ministry of Transport Inspectorate, Specialized Maritime Inspectors, individuals assigned to perform maritime inspection tasks, officials and staff of the Maritime Administration, make records of the following administrative violations:

- Violations of maritime regulations outside the port waters;- Violations of regulations on marine environmental protection;

4. Fisheries surveillance officers, positions authorized to impose administrative penalties within the Fisheries Surveillance force, make records of the following administrative violations:

- Violations of regulations on nets collection and the state of fish finders when operating within the territorial waters, contiguous zone, and exclusive economic zone of Vietnam by foreign vessels;- Infringements on the seas, islands, and continental shelf of the Socialist Republic of Vietnam for the purpose of exploiting, buying, or selling aquatic products;- Violations of regulations ensuring legal activities on the seas, islands, and continental shelf of the Socialist Republic of Vietnam;

5. Team Leaders under the Sub-department of Customs, Team Leaders under the Post-Clearance Inspection Sub-department, make records of the following administrative violations:

- Loading, unloading, exchanging, buying, or selling goods, currencies, or embarking or disembarking individuals onto vessels against the laws of Vietnam on customs, taxes, health, or immigration;- Violations of regulations on transporting, buying, exchanging, transferring goods illicitly on the seas, islands, and continental shelf of the Socialist Republic of Vietnam;

6. Market inspectors, make records of administrative violations related to:

- Violations of regulations on transporting, buying, exchanging, transferring goods illicitly on the seas, islands, and continental shelf of the Socialist Republic of Vietnam.
