The 2014 revised Law on Officers of the Vietnam People's Army, issued on November 27, 2014, amended and supplemented certain articles of the 1999 Law on Officers of the Vietnam People's Army. Notably, the content of amendments and supplements pertains to the authority to make decisions concerning officers.
To be specific:, according to Clause 5, Article 1 of the amended 2014 Law on Officers of the Vietnam People's Army, which amends and supplements Article 25 of the 1999 Law on Officers of the Vietnam People's Army, the authority to make decisions regarding officers is specified as follows:
- Authority to appoint, dismiss, relieve from duty, confer, promote, demote, strip military ranks of officers:
- The President appoints, dismisses, relieves from duty the Chief of the General Staff, Chairman of the General Political Department; confers, promotes, demotes, strips military ranks of generals, Rear Admirals, Vice Admirals, Admirals of the Navy;- The Prime Minister of the Government of Vietnam appoints, dismisses, relieves from duty Deputy Ministers; Deputy Chief of the General Staff, Deputy Chairman of the General Political Department; Director, Political Commissar of the National Defense Academy; Head of the General Department, General Director, Political Commissar of the General Department; Commanders, Political Commissars of Military Regions; Commanders, Political Commissars of Military Services; Commanders, Political Commissars of the Border Defense Force; Commanders, Political Commissars of the Vietnam Coast Guard; Chief of the Cipher Committee the Government of Vietnam and other positions as regulated by the competent authority;- The Minister of National Defense appoints, dismisses, relieves from duty other positions and confers, promotes, demotes, strips the remaining military ranks and increases officers' pay;- The appointment, dismissal, and relieving from duty of positions in the military prosecutor's office, courts, and military execution are carried out in accordance with the law.
- The competent authority that decides an appointment to a position is also authorized to dismiss, relieve from duty, demote, extend the active service period, transfer, second, assign to a lower position, release from active service, transfer, and remove reserve officer status for such position.
