Authority for Conferring, Promoting, and Demoting Military Ranks for Non-Commissioned Officers and Enlisted Soldiers

On January 26, 2016, the Ministry of National Defense issued Circular 07/2016/TT-BQP specifically stipulating the authority to confer, promote, or demote military ranks of non-commissioned officers and soldiers.

Accordingly, the authority to appoint, promote, and demote the military ranks of non-commissioned officers and soldiers is stipulated in Circular 07 as follows:

Regarding the appointment of the rank of Private:

- The Regiment Commander, Brigade Commander, and equivalent positions shall decide on the appointment of the rank of Private for military personnel under their command;- The Commander of the District-level Military Command (including districts, counties, district-level towns, provincial cities, and equivalent administrative units) (hereinafter referred to as the District-level Military Command Commander) shall decide on the appointment of the rank of Private for citizens registered for service in the reserve force of the People’s Army who have been arranged and appointed to the reserve mobilization unit.

Regarding the promotion and demotion of non-commissioned officers and soldiers in active service:

- The Battalion Commander and equivalent positions shall decide on the promotion to the rank of Private First Class for soldiers under their command;- The Regiment Commander, Brigade Commander, and equivalent positions shall decide on the promotion and demotion to the rank of Corporal for non-commissioned officers and soldiers under their command;- The Division Commander and equivalent positions shall decide on the promotion and demotion to the rank of Sergeant for non-commissioned officers and soldiers under their command.

Note that in cases where non-commissioned officers and soldiers violate discipline and are deemed no longer qualified as military personnel, they shall be disciplined by being stripped of their military titles according to the regulations of the People's Army of Vietnam’s Military Management Regulations.

Circular 07 also stipulates the promotion and demotion of the military ranks for non-commissioned officers and reserve soldiers as follows:

- The District-level Military Command Commander shall decide on the promotion and demotion to the rank of Corporal for non-commissioned officers and soldiers registered for service in the reserve force of the People’s Army who have been arranged and appointed to the reserve mobilization unit;- The Provincial-level Military Command Commander, including the Commanders of the Military Commands of provinces and centrally-run cities, the Hanoi Capital Command, and the Ho Chi Minh City Command (hereinafter referred to as the Provincial-level Military Command Commander) shall decide on the promotion and demotion to the rank of Sergeant for non-commissioned officers and soldiers registered for service in the reserve force of the People’s Army who have been arranged and appointed to the reserve mobilization unit.
