Below are the provisions regarding the authority and procedures for recognizing regional parent universities, national universities in Vietnam from November 20, 2024.

Authority and procedures for recognizing regional parent universities, national universities in Vietnam

On October 5, 2024, the Government of Vietnam issued Decree 125/2024/ND-CP which stipulates the conditions for investment and operation in the field of education in Vietnam.

Within this decree, Article 105 of Decree 125/2024/ND-CP prescribes the authority and procedures for recognizing regional parent universities and national universities in Vietnam with the following contents:

Authority:

The Prime Minister of the Government of Vietnam decides on the recognition of regional parent universities and national universities.

Application for recognition of regional parent universities, national universities:

- Proposal for recognition of regional parent universities, national universities (according to Form No. 12, Appendix III attached to Decree 125/2024/ND-CP);

- Proof of meeting the conditions stipulated in Clause 1, Clause 2 of Article 104 of Decree 125/2024/ND-CP;

- Report on the results of implementing the development project into a regional university, national university along with proofs of meeting the objectives and targets according to the project's timeline;

- Draft regulations on the organization and operation of regional parent universities, national universities; provisions on organization, finance, assets; other contents (if any).

Procedures:

- The university submits one dossier as prescribed in Clause 2 of this Article via an online public service portal or by postal service or directly to the Ministry of Education and Training of Vietnam;

- Within 15 days from the date of receiving the dossier, if the dossier is not valid, the Ministry of Education and Training of Vietnam is responsible for notifying in writing for the university to amend and supplement;

- For valid dossiers, within 90 days from the date of receiving the complete dossier, the Ministry of Education and Training of Vietnam is responsible for leading and cooperating with relevant agencies to appraise the dossier and conduct practical appraisals to accurately evaluate the university’s project implementation status, prepare an appraisal report, complete the dossier and submit to the Ministry of Planning and Investment, Ministry of Finance, Ministry of Home Affairs, and related agencies for their written feedback; if the conditions are not met, notify in writing to the university, stating the reasons.

The practical appraisal is carried out by the Appraisal Council, which includes representatives from the Ministry of Education and Training of Vietnam, Ministry of Planning and Investment, Ministry of Home Affairs, Ministry of Finance, and the Provincial People's Committee where the university's main office is located. The Appraisal Council is established by the decision of the Minister of Education and Training and is tasked with advising the Minister on the feasibility and practical suitability of the proposal dossier for recognizing regional parent universities and national universities for the Prime Minister's consideration and decision;

- Within 30 days from the date of receiving all written feedback from the agencies stipulated at Point c, Clause 3, Article 105 of Decree 125/2024/ND-CP, the Ministry of Education and Training of Vietnam compiles the feedback, completes the dossier, and submits it to the Prime Minister for consideration and decision;

- The decision to recognize regional parent universities, national universities (according to Form No. 13, Appendix III attached to Decree 125/2024/ND-CP) is publicly announced in the mass media.

Regulations for recognizing regional parent universities, national universities in Vietnam

(1) Universities and constituent universities (if any) must meet all standards and criteria of the Higher Education Institution Standard for doctoral training institutions and be recognized for meeting the education quality standards as stipulated by the Ministry of Education and Training of Vietnam.

(2) They must offer doctoral training in fields spanning: Natural Sciences, Mathematics and Statistics, Engineering, Computer and Information Technology, Social and Behavioral Sciences, Humanities, Business and Management.

(3) There must be a development project to become a regional university, national university approved and implemented by the Prime Minister of the Government of Vietnam, aligned with the planning of the university and teacher training network and regional planning. The project's content must clearly state: the necessity of developing into a regional university, national university; development goals as a regional university, national university; targets necessary for the university to have the capability to perform its role and mission as a regional university, national university; tasks, solutions, resources, and timeline for executing the project to achieve the set objectives and targets.
