Assessment of the Quality of Public Service Activities Ensuring Maritime Safety

This content is stipulated in Circular 42/2019/TT-BGTVT of the Ministry of Transport, regulating the criteria, inspection, supervision, evaluation, and acceptance of the quality of public service operations ensuring maritime safety.

The evaluation of the quality of public non-business services ensuring maritime safety is based on the criteria stipulated in the Appendices issued alongside Circular 42/2019/TT-BGTVT and is assessed as “Pass” or “Fail”. If one of the criteria under the “Fail” sections is not met, the overall assessment of that section is “Fail”. To be specific:

  1. Evaluation of the management and operation service of lighthouses and independent buoys:

- The criteria from (1) to (5) Appendix 1 issued alongside this Circular, if “Fail”, require the public non-business service provider ensuring maritime safety to rectify immediately (within 15 days from the date of receiving a written notice from the Vietnam Maritime Administration) and reevaluate the “Fail” criteria.- The criterion in section (6) Appendix 1 issued alongside this Circular, if “Fail”, results in the overall quality assessment of the management, operation, and maintenance of the public maritime signaling system for the cycle being “Fail”.

  1. Evaluation of the management, operation, and maintenance service of the public maritime signaling system:

- The criteria from (1) to (5) Appendix 2 issued alongside this Circular, if “Fail”, require the public non-business service provider ensuring maritime safety to rectify immediately (within 15 days from the date of receiving a written notice from the Vietnam Maritime Administration) and reevaluate the “Fail” criteria.- The criterion in section (6) Appendix 2 issued alongside this Circular, if “Fail”, results in the overall quality assessment of the management, operation, and maintenance of the public maritime signaling system for the cycle being “Fail”.

  1. Evaluation of the management, operation, and maintenance service of the breakwater, sand flow deflection dyke, and riverbank protection structures of public maritime infrastructure:The criteria stipulated in Appendix 3 issued alongside this Circular, if “Fail”, require the public non-business service provider ensuring maritime safety to rectify immediately (within 15 days from the date of receiving a written notice from the Vietnam Maritime Administration) and reevaluate the “Fail” criteria.

  2. Evaluation of the survey service for public maritime channels (including pilot boarding areas):The criteria stipulated in Appendix 4 issued alongside this Circular, if “Fail”, require the public non-business service provider ensuring maritime safety to rectify immediately (within 15 days from the date of receiving a written notice from the Vietnam Maritime Administration) and reevaluate the “Fail” criteria.

  3. Evaluation of the unexpected service ensuring maritime safety:The criteria stipulated in Appendix 5 issued alongside this Circular, if “Fail”, require the public non-business service provider ensuring maritime safety to rectify immediately (within 15 days from the date of receiving a written notice from the Vietnam Maritime Administration) and reevaluate the “Fail” criteria.

The Vietnam Maritime Administration shall base on the quarterly or unexpected inspection and supervision results to accept the quality of public non-business services ensuring maritime safety for 6 months and the whole year. The acceptance of the quality of public non-business services ensuring maritime safety shall be performed when all quality criteria are assessed as “Pass”.
