Assessment and classification of Vietnamese officials, public employees, and employees in 2018

The assessment and classification of Vietnamese officials and public employees and workers in 2018 are carried out in accordance with the provisions of Decree 88/2017/ND-CP and Decree 56/2015/ND-CP.

According to Official Dispatch 4948/LD-TCCB dated November 22, 2018, the principles, subjects, timing, authority, and procedures for assessing and classifying officials and public employees and employees in Vietnam are carried out in accordance with the regulations in the following documents:

- Decree 88/2017/ND-CP amending and supplementing a number of articles of Decree 56/2015/ND-CP on the assessment and classification of officials and public employees;

- Official Dispatch 4978/LD-TCCB dated November 28, 2017, guiding the assessment and classification of officials and public employees and employees.

Assessment principles

- Correct assessment authority;

- The assessment must be based on assigned tasks and the results of task performance (clearly stating strengths, weaknesses, existing issues, limitations in qualities, capabilities, and competencies);- Objective, fair, precise, and without favoritism, bias, or superficiality;

- The assessment and classification of officials and public employees in leadership and management positions must be based on the performance results of the unit assigned for leadership and management (note that the performance level of the unit head must not exceed that of the unit);

- In cases where officials and public employees and employees fail to complete tasks due to objective and force majeure factors, this will be considered during the assessment and classification process.

Subjects for assessment

Officials and public employees and employees working under labor contract policies according to Decree 68/2000/ND-CP

Timing of assessment

- The assessment and classification are conducted in December, before the annual emulation and commendation review. For public service providers operating in education, training, and several other fields with the end of the working year before December each year, the unit's head decides on the time for assessment and classification of officials and public employees and employees.

- If transferring to another unit, that unit is responsible for assessment and classification in combination with feedback from the former unit (if the working period in the former unit is 06 months or more).

Assessment and classification authority

- The unit head assesss and classifies officials and public employees and employees under their management (including Deputy Heads of the unit)

- The Minister assesss and classifies Deputy Ministers, heads of state management units, and public service providers under the Ministry (including heads of units under General Departments and Departments);

Assessment and classification process

- Civil servants, public employees, and employees assess their task performance (according to forms No. 02, 03 issued together with Decree 56/2015/ND-CP);

- Organize meetings to provide feedback and comments according to the following procedure:

For units without departmental structure:

- The unit head convenes and chairs the meeting:

- The unit head, deputy head, officials and public employees, and employees present self-assessment reports on work results;

- Meeting participants provide feedback on the self-assessment of the unit head, deputy head, officials and public employees, and employees according to assessment and classification criteria (feedback in the meeting is recorded in the minutes and passed in the meeting);

- The equivalent party cell gives written opinions on the officials and public employees assessd and classified (applies only to officials and public employees holding leadership and management positions).

- The deputy head of the unit aggregates and records collective feedback at point 1 in section III and personal feedback at point 2 in section III form No. 02, 03 Decree 56/2015 for officials and public employees and employees directly managed.

- The unit head refers to the collected feedback (recorded in the minutes), decides on the assessment and classification of the deputy head, officials and public employees, and employees, and enters it in section IV form No. 02, 03 Decree 56/2015 (note for the deputy head, also enter point 1 in section III form No. 02, 03 Decree 56/2015).

For units with departmental, faculty, or equivalent structures:

- The unit leader responsible convenes and chairs a meeting of all officials and public employees and employees of the department to provide feedback on the head, deputy head, officials and public employees, and employees of the department:

- The head, deputy head, officials and public employees, and employees present self-assessment reports;

- Participants provide feedback on the self-assessment of the head, deputy head, officials and public employees, and employees according to assessment and classification criteria (note: feedback in the meeting is recorded in the minutes and passed in the meeting);

- The department head aggregates and records collective feedback at point 1 in section III and personal feedback at point 2 in section III form No. 02, 03 Decree 56/2015 for the deputy head, officials and public employees, and employees directly managed.

- The unit head convenes and chairs the meeting which includes the unit head, deputy head, department heads, representatives of the party cell, trade union, and youth union to provide feedback on the unit head, deputy head, and department heads:

- The unit head, deputy head, and department heads present self-assessment reports according to assigned tasks;

- Participants provide feedback (note: feedback is recorded in the minutes and passed in the meeting);

- The equivalent party cell gives written opinions on the officials and public employees assessd and classified (applies only to officials and public employees holding leadership and management positions);

- The deputy head aggregates and records collective feedback at point 1 in section III and personal feedback at point 2 in section III form No. 02, 03 Decree 56/2015 for the department head directly managed.

- The unit head consults the collected feedback (recorded in the minutes), decides on the assessment and classification of the deputy head, department leaders, officials and public employees and employees, and enters it in section IV form No. 02, 03 Decree 56/2015 (note for the deputy head, also enter point 1 in section III form No. 02, 03).

- The Personnel Department sends the Unit head’s assessment and classification form along with the meeting minutes, written opinions of the equivalent party cell and related documents to the Ministry (through the Personnel Department) no later than January 5 of the following year for the Ministry’s Leadership to consider and decide on the assessment and classification of the unit head (note: for the assessment and classification form of the unit head, the unit is required to summarize collective feedback in point 1 of section III; point 2 is left blank without signature).

- The unit head is responsible for notifying the assessment and classification results in writing to officials and public employees and employees within 05 working days from the date of conclusion by the competent authority.

- The Personnel Department is responsible for archiving the assessment and classification form (signed and stamped by the competent authority), written notification of the assessment and classification results, and related documents in the personnel files of officials and public employees and employees.

Note on documentation

- The assessment and classification documents of unit heads (including individual assessment and classification form; meeting minutes; written opinions of the equivalent party cell; related documents such as scientific works, projects, topics, or initiatives effectively applied in the unit's public activities that are recognized by a competent authority).

- Summary table of assessment results of officials and public employees and employees; a list of officials and public employees and employees who did not complete the tasks specifying the reasons for non-completion (according to the attached form).
