The selection of architectural design proposals is the organization of a competition to choose the optimal architectural design that meets the requirements of planning, architecture, culture, socio-economic efficiency, national defense, security, and environmental protection. To be specific, Article 17 of the 2019 Architecture Law stipulates that projects requiring an architectural design proposal selection include:
- Public projects on a special scale, Level I;
- Provincial central railway stations, civil aviation terminals; urban bridges from Level II and above, urban railway stations from Level II and above; monument projects, projects symbolizing local tradition, culture, and history; important projects, landmarks in urban areas and on main roads identified in planning designs, urban designs, architectural management regulations approved by competent authorities.
Moreover, the Law stipulates that the organization of an architectural design proposal selection is proposed in the investment policy or pre-feasibility study report. The investment decision maker decides the form of the architectural design proposal selection and establishes the Architectural Design Proposal Selection Council. The cost of the architectural design proposal selection is included in the total investment of the project.
Based on the winning architectural design proposal, the organization or individual with the winning proposal can proceed with the next steps of the project when conditions are met according to the provisions of the construction law and the bidding law. Information about the selection process, the Architectural Design Proposal Selection Council, and the competition results must be publicly disclosed by the investor on mass media.
