Approval of the Scheme on national railway infrastructure property in Vietnam 

Decision 797/QD-TTg dated August 5, 2024, issued by the Prime Minister of the Government of Vietnam, approves the Scheme on Management, Use, and Exploitation of national railway infrastructure property invested and managed by the State with the following key contents:

(1) Plan for Assignment of Management, Use, and Exploitation of national railway infrastructure property invested and managed by the State

- Phase until the end of 2030:

Assign the Vietnam Railway Corporation (an enterprise operating national railway infrastructure, with 100% charter capital held by the State) to manage, use, and exploit the national railway infrastructure property invested and managed by the State in the form of not accounting it as state capital in the enterprise.

- Phase after 2030:

The Ministry of Transport will organize an evaluation of the actual status and efficiency of the management, use, and exploitation of the national railway infrastructure property invested and managed by the State in the previous phase to decide on the asset delegation according to the provisions of the law.

(2) Mechanism for Management, Use, and Exploitation of national railway infrastructure property invested and managed by the State until the end of 2030

- Principles for implementing management and maintenance of national railway infrastructure property invested and managed by the State

+ The work of management and maintenance of national railway infrastructure property shall be implemented in accordance with the Law on Management and Use of Public Assets, the Railway Law, the State Budget Law, and the Government of Vietnam’s Decree on the management, use, and exploitation of national railway infrastructure property, quality management and building maintenance laws, and other relevant laws.

+ The Ministry of Transport to allocate budget estimates and organize the implementation of management and maintenance of national railway infrastructure according to the provisions of the Law on State Budget, the Law on Management and Use of Public Assets, the Railway Law, and other relevant laws.

- Mechanism for management and maintenance of national railway infrastructure property invested and managed by the State assigned to the Vietnam Railway Corporation for management and exploitation

+ The Ministry of Transport organizes the complete ordering for managing and maintaining the national railway infrastructure with the Vietnam Railway Corporation; the Vietnam Railway Corporation organizes, implements, and is responsible to the Government of Vietnam, the Prime Minister of the Government of Vietnam, and the Ministry of Transport for the management and maintenance of the national railway infrastructure, ensuring the continuity, orderliness, safety, and accuracy of railway transportation operations in conformity with the law.

+ The implementation of the contract ordering follows the provisions of the law; in case the legal provisions are inadequate and do not fit the realities during application, the Ministry of Transport shall gather information and report to competent authorities for review and decision.

- Mechanism for exploiting national railway infrastructure property invested and managed by the State

+ Providing railway transportation operational services

++ The Vietnam Railway Corporation provides railway transportation operational services on the national railway infrastructure property assigned for management and other related contents accordance with the law.

++ Railway transport businesses are obliged to pay fees for the use of national railway infrastructure according to the Law on Management and Use of Public Assets, the Railway Law, the Law on Fees and Charges, and other relevant laws.

+ Exploiting national railway infrastructure property invested and managed by the State

The Vietnam Railway Corporation shall organize the exploitation of the assets and manage and utilize the revenue from the exploitation of the national railway infrastructure property assigned according to the law and the guidance of competent state agencies.

- Handling national railway infrastructure property invested and managed by the State

The handling of assets and management and utilization of revenue from handling the national railway infrastructure property shall be implemented in accordance with the law and the guidance of competent state agencies.

(3) Process and procedures for handing over and receiving to manage, use, and exploit national railway infrastructure property invested and managed by the State until the end of 2030

- The Vietnam Railway Corporation presides over the review, categorization, and listing of national railway infrastructure asset categories, quantities, and values currently managed and used to prepare a submission for asset management, presents it to the Ministry of Transport; presides over the valuation to log the national railway infrastructure property for those without original cost and remaining book value, and submits it to the Ministry of Transport for approval; reports on the management, usage, and exploitation status of national railway infrastructure property as of the time of performing the handover procedures according to the law.

- The Ministry of Transport organizes the inspection of the asset management proposal dossier and performs procedures to submit to the Prime Minister of the Government of Vietnam for deciding the management assignment of the national railway infrastructure property invested and managed by the State according to the law; directs, checks, and supervises the implementation of the handover and receipt of national railway infrastructure property according to the decision of the Prime Minister of the Government of Vietnam and the law's regulations.
