Regarding this issue, LawNet would like to answer as follows:

Approval of the Plan for electricity supply and operation of the national electricity system in 2024 in Vietnam

On November 30, 2023, the Minister of Industry and Trade issued Decision 3110/QD-BCT approving the Plan for electricity supply and operation of the national electricity system in 2024.

Approve the Plan for power supply and operation of the national power system in 2024 submitted by Vietnam Electricity Group in Official Dispatch 7088/EVN-KH+TTD+KTSX+TCKT dated November 28, 2023 as follows:

- Total electricity produced by power plants (at generator terminals) and imported nationwide in 2024 is 306.259 billion kWh, of which the dry season is 148.489 billion kWh and the rainy season is 157.769 billion kWh.

- Actual electricity purchase output of power plants (according to electricity purchase contracts and electricity price plans) will be determined according to relevant regulations on electricity prices and electricity markets. Power generation units are responsible for proactively carrying out power generation preparations, including ensuring the ready capacity of generating units and arranging primary fuel sources (coal, gas, and oil) sufficient for power generation monthly in 2024.

- Vietnam Electricity Group takes full responsibility for the accuracy, reasonableness, and validity of input data/parameters and calculation results of the 2024 Power Supply and System Operation Plan, ensuring compliance with commitments in signed Power Purchase and Fuel Supply Contracts/Commercial Agreements, especially Commercial Contracts/Agreements with invested power plant projects in the form of build-operate-transfer (BOT), and being responsible in the event of a dispute according to the committed terms or for arising unfavorable legal and financial obligations for the Vietnamese side. .

* Vietnam Electricity Group (EVN) is responsible for:

- Promote the leading role and take the main responsibility in ensuring electricity supply for the needs of socio-economic development and people's daily lives with good quality, stability, reliability, and safety; promptly report to competent authorities to resolve issues beyond authority; absolutely do not let an electricity supply-demand imbalance occur due to subjective reasons;

- Announce the Plan for power supply and operation of the national power system in 2024, including the plan to mobilize monthly power output in 2024 according to Option 4a in Official Dispatch 7088/EVN-KH+TTD+KTSX+TCKT for investors of power plants and related units to proactively plan and prepare for electricity production;

- Periodically before the 15th of the last month of every quarter, review, update data, and recalculate the National Electricity System Operation and Supply Plan for the remaining months of 2024, submit it to the Ministry of Industry and Trade for review and adjustment of the 2024 Electricity Supply and Operation Plan approved in Article 1 of this Decision;

- On a monthly basis, review, update, approve, and announce, according to regulations, the Plan for electricity supply and operation of the national electricity system for the next month and the remaining months of 2024 on the basis of closely following the actual developments of electricity loads, weather conditions (temperature, hydrology), operating conditions of the electricity system, and the electricity market.to determine the monthly contract output of power plants participating in the electricity market; Before March 15, 2024, prepare and report to the Ministry of Industry and Trade a Plan to ensure electricity for the national electricity system, especially the North, during the peak months of the dry season (April–June) of 2024 with scenarios to control and respond to difficulties in power supply, with backup to ensure response to extreme situations, incidents, and overlapping difficulties;

- Direct affiliated units to prepare plans to ensure electricity supply for holidays, the New Year, and major political and cultural events in 2024;

- Establish operating methods and reasonably mobilize power sources (including renewable energy sources) in the national power system to ensure sufficient power supply on the basis of the principles of transparency, fairness, and cost optimization of the entire system, in accordance with the technical infrastructure conditions of the power grid and legal regulations; Direct the Power Corporations and Power Companies to develop and publish according to regulations on annual/monthly/weekly/daily operating plans, including plans to deal with extreme situations at risk of imbalance between electricity supply and demand, proactively reporting to the Departments of Industry and Trade of provinces and centrally run cities;

- Strengthen leadership and direction to accelerate the progress of ongoing construction investment projects and projects included in approved plans, ensuring capacity release for power sources; reduce load on lines and transformers that are operating at full capacity and overload; coordinate with local authorities to focus on directing and completely handling difficulties in compensation and site clearance for key power grid projects, especially the 500kV circuit 3 line project of Quang Trach-Pho Noi; fully prepare the necessary conditions to ensure safe, efficient, stable, and continuous operation of Phu My 3 and Phu My 2.2 power plants after completing reception procedures;

- Strengthen the direction and management of power generation units under its management in terms of maintenance, repair, and good preparation of conditions to ensure safe and stable electricity production according to the operation and mobilization plan of the national power system; Closely monitor and supervise the operation of the power plant's equipment to prevent subjective incidents from occurring; Strengthen inspection and consolidation of equipment, fix defects to ensure improved operational reliability, improve the power generation capacity of generating sets, and minimize generator set incidents; Safe operation of the power grid system, especially the 500 kV North-Central - South power transmission system; Arrange a suitable repair schedule for power sources, economically use hydroelectric water sources, and improve the availability of power sources, especially during the peak of the dry season in the North; Coordinate with electricity customers, especially large electricity customers, to prepare scenarios and plans to implement the electricity load adjustment program in case of necessity to ensure electricity system security.
