Content mentioned in Decision 1277/QD-TTg in 2023 approving the national mineral reserve area issued by the Prime Minister.
93 national mineral reserve areas for 10 specific types of minerals are approved, as follows:
1. Energy coal: 02 areas.
2. Apatite ore: 02 areas.
3. Lead - zinc ore: 01 area.
4. Chromite ore: 03 areas.
5. Titanium ore: 14 areas.
6. Bauxite ore: 23 areas.
7. Iron ore-laterite: 14 areas.
8. White marble: 17 areas.
9. White sand: 15 areas.
10. Rare earth ores: 02 areas.
Details of coordinates, area, depth, resources, reserves, and reserve time of each national mineral reserve area are in the Appendix issued with Decision 1277/QD-TTg in 2023.
During the reserve period of the national mineral reserve areas mentioned in Article 1 of this Decision, the management and protection of unexploited minerals; and the implementation of investment projects in national mineral reserves must comply with the provisions of Decree No. 51/2021/ND-CP dated April 1, 2021, of the Government on mineral management in national mineral reserve areas, the provisions of the law on minerals, and the following regulations:
- Mineral exploration licenses and mineral exploitation licenses that have been issued by competent authorities before the date of issuance of this Decision and are not part of the reserve minerals mentioned in Article 1 of this Decision, continue to comply with the content of the issued license and the provisions of the law on minerals.
- Areas with minerals other than reserve minerals mentioned in Article 1 of this Decision have been included in the relevant mineral planning that have not yet been licensed for exploration and exploitation or have not been included in the relevant mineral planning can be planned and licensed for exploration and exploitation according to the provisions of the law on minerals but must not affect minerals that have been delineated as national mineral reserve areas.
Implementation organization
1. The Ministry of Natural Resources and Environment is responsible for:
- Preside over and coordinate with the People's Committees of relevant provinces and centrally run cities to publicize approved national mineral reserve areas mentioned in Article 1 of this Decision;
- Hand over the dossier delineating the national mineral reserve area to the People's Committee of the province or centrally run city where the national mineral reserve area is located for management and protection according to regulations;
- Take full responsibility for reports, data, and proposals to delineate mineral reserve areas.
2. The People's Committee of the province or centrally run city where the national mineral reserve area is located is responsible for:
- Receive and manage dossiers for delineating national mineral reserve areas handed over by the Ministry of Natural Resources and Environment according to regulations;
- Update relevant information and documents about the national mineral reserve area in the plan to protect unexploited minerals in the local area; Organize the management and protection of unexploited minerals within national mineral reserve areas according to the provisions of Article 2 of this Decision, including areas with resources and reserves that have been subject to basic geological surveys of minerals and mineral exploration but are not delineated as defined national mineral reserve areas in the dossier delineating the national mineral reserve area;
- Update, supplement, and adjust planning, land use plans, and related mineral planning in the area and submit them to competent authorities for approval.
