According to Article 24 of Decree 115/2020/ND-CP, the appointment to the professional title of public employee after the apprenticeship period in Vietnam is regulated as follows:

  • At the end of the apprenticeship period, the intern must report the results of the probation by a written document as prescribed in Clause 3, Article 21 of Decree 115/2020/ND-CP; the probation guide is responsible for providing written comments and assessment of the intern's results. These documents are sent to the head of the public non-business unit.

  • No later than 05 working days from the date of receipt of the probation report and the evaluation of the probation guide, the head of the public non-business unit will assess the political quality, ethics, and work results of the intern. If the intern meets the requirements, the head of the public non-business unit will decide within their authority or has a written request for the competent authority to manage the public non-business unit to decide on the appointment of the professional title and salary arrangement for the recruited public employee.

In cases where the employment contract with the intern is terminated in Vietnam, the following steps will be taken:

  • The intern will have their employment contract terminated and the recruitment decision canceled if they do not meet the requirements after the probation period or have committed violations that warrant disciplinary action as prescribed by law.

  • The head of the public non-business unit will terminate the employment contract and report to the competent authority to cancel the recruitment decision for the aforementioned cases.

  • The intern whose employment contract is terminated will receive compensation of 01 month's salary, current allowances, and travel expenses back to their place of residence from the public non-business unit.
