Appraising and approving the natural disaster response plan applied to works and dam lowlands in Vietnam

Recently, the Government of Vietnam has issued the Decree No. 114/2018/NĐ-CP on dam and reservoir safety management.

Specifically, according to Article 7 of the Decree No. 114/2018/NĐ-CP of Vietnam’s Government, appraising and approving the natural disaster response plan applied to works and dam lowlands during construction are as follows:

1. Application for appraisal

The investor in dam and reservoir construction that requests approval for the natural disaster response plan for works and dam lowlands shall submit an application for appraisal directly or by post to the receiving authority. The application includes:

- An application form for ratification of the response plan made for works and dam lowlands;

- A draft of natural disaster response plan for works and lowlands;

- A report on the result of technical calculation;

- Opinions in writing from relevant agencies;

- Other relevant documents (if any).

2. Appraisal matters

- Checking legal bases of the application;

- Checking and assessing the reliability of documents used in the plan;

- Judging the reasonability of the application and the draft plan.

3. Appraisal procedure

- The receiving authority shall consider and check the application within 3 working days from the day such application is received; in case the application is found unsatisfactory, such authority shall give a written notice to the applicant for him/her to complete the application as regulated;

- The receiving authority shall appraise the application and carry out on-site inspection where necessary and submit such application to competent authorities for approval purpose within 20 working days from the day on which the satisfactory application is received; if the application is found ineligible for approval, the receiving authority shall return such application to the applicant and give written explanation.
