Appointment, Dismissal, Assignment, and Recall of the Head of the Representative Office

The National Assembly passed the amended Law on the Representative Agencies of Vietnam Abroad 2017 on November 21, 2017. This law amended and supplemented provisions on the appointment, dismissal, delegation, and recall of the heads of representative agencies, which were previously stipulated in the Law on the Representative Agencies of Vietnam Abroad 2009.

To be specific, according to Clause 7, Article 1 of the amended Law on Representative Agencies of the Socialist Republic of Vietnam Abroad 2017, amending and supplementing Article 20 of the Law on Representative Agencies of Vietnam Abroad 2009, the regulations on the appointment, dismissal, assignment, and recall of the head of representative agencies are as follows:

  1. The Standing Committee of the National Assembly approves the Prime Minister of the Government of Vietnam's proposal regarding the appointment and dismissal of the head of a representative agency as an Ambassador Extraordinary and Plenipotentiary.

  2. Based on the resolution of the Standing Committee of the National Assembly, the President appoints and dismisses; decides to assign and recall the head of a representative agency as an Ambassador Extraordinary and Plenipotentiary.

  3. The President decides to assign and recall the head of a representative agency as a Representative of the President at international organizations, based on the Prime Minister of the Government of Vietnam's proposal, except for the case stipulated in Clause 2, Article 20 of the Law on Representative Agencies of Vietnam Abroad 2009.

  4. The Minister of Foreign Affairs decides to appoint and recall the head of a representative agency, except for the cases stipulated in Clauses 1, 2, and 3, Article 20 of the Law on Representative Agencies of Vietnam Abroad 2009.

  5. The head of a representative agency in a country or international organization may be appointed concurrently as the head of a representative agency in another country or international organization.
