Application for settlement of monthly pensions for servicemen in Vietnam

Recently, the Ministry of National Defense issued Circular 136/2020/TT-BQP providing guidance on documents, procedures, and responsibilities for social insurance benefits in the Ministry of National Defense of Vietnam.

Article 22 of Circular 136/2020/TT-BQP stipulates the application for settlement of monthly pensions for servicemen; personnel performing essential tasks receiving salaries as for servicemen; defense officials, employees, and defense public employees; contracted employees in agencies, units, and enterprises under the Ministry of National Defense, including:

1. Social Insurance Book.

2. Decision to retire to enjoy the social insurance regime issued by the competent authority according to Form 05 attached to Circular 70/2016/TT-BQP dated June 2, 2016 of the Minister of National Defense regulating the sequence, procedures for demobilization, and retirement for officers, professional servicemen, employees, and defense public employees, as well as individuals working in essential organizations receiving salaries from the state budget managed by the Minister of National Defense.

3. Original copy of the assessment report on the degree of labor capacity reduction by the competent medical assessment Council in the Ministry of National Defense for retired individuals due to labor capacity reduction; a certificate of HIV/AIDS infection due to occupational accidents issued by the competent authority for retired individuals infected with HIV/AIDS due to occupational accidents.

4. Form about the process of paying social insurance (Form 04A-HBQP).

5. Decision on monthly retirement benefits (Form 07A-HBQP to Form 07C-HBQP).

6. Notice of pension and social insurance allowance transfer (Form 10A-HBQP).

7. In addition to the above-mentioned documents, for the following cases, additional documents are required:

  • In the case of individuals being received by the unit after being released from prison: Certified copy of the completed sentence execution certificate or decision to release from prison before the term or decision of the competent authority regarding exemption or temporary suspension of sentence execution for individuals who are required to serve a prison sentence from January 1, 1995, to December 31, 2015; decision to receive and rank salary by the competent authority; request for retirement benefits (Form 14-HBQP);
  • In the case of workers being sentenced to prison from January 1, 2016, onwards, during the period of serving the sentence but meeting the retirement conditions as prescribed: Power of attorney for receiving a pension (Form 13B-HBQP), request for retirement benefits (Form 14-HBQP);
  • In the case of workers who meet the retirement age but lack the maximum period of social insurance contribution by no more than 06 months: Request for one-time social insurance contribution for retirement benefits (Form 14-HBQP) and receipt for one-time social insurance contribution;
  • In the case of workers who served in areas eligible for regional allowances before January 2007: personal declaration of time, area of service for the military entitled to regional allowances (Form 04B-HBQP);
  • In the case of missing persons returning: an in-effect decision of the Court to cancel the declaration of missing status for the returned missing person;
  • In the case of workers participating in labor cooperation before January 1, 1995, the file shall be processed according to the provisions of Clause 3, Article 35 of Circular 59/2015/TT-BLDTBXH dated December 29, 2015, of the Minister of Labor - Invalids, and Social Affairs providing detailed regulations and guidance on the implementation of certain provisions of the Social Insurance Law on compulsory social insurance (hereinafter referred to as Circular 59/2015/TT-BLDTBXH).
  • Individuals receiving pensions according to Decree 159/2006/ND-CP; Decree 11/2011/ND-CP, the file shall be processed according to the provisions of Clause 1, Section III of Joint Circular 69/2007/TTLT-BQP-BLDTBXH-BTC dated April 16, 2007, of the Ministry of National Defense, Ministry of Labor - Invalids and Social Affairs, Ministry of Finance guiding the implementation of Decree 159/2006/ND-CP (hereinafter referred to as Joint Circular 69/2007/TTLT-BQP-BLDTBXH-BTC) and Clause 6, Article 1 of Joint Circular 190/2011/TTLT-BQP-BLDTBXH-BTC dated November 7, 2011, of the Ministry of National Defense, Ministry of Labor - Invalids and Social Affairs, Ministry of Finance amending and supplementing Joint Circular 69/2007/TTLT-BQP-BLDTBXH-BTC.
  • For individuals receiving pensions according to Decree 23/2012/ND-CP, the application shall be processed according to the provisions of Clause 2, Article 5 of Joint Circular 102/2012/TTLT-BQP-BLDTBXH-BTC dated October 19, 2012, of the Ministry of National Defense, Ministry of Labor - Invalids, and Social Affairs, Ministry of Finance, guiding the implementation of Decree 23/2012/ND-CP.

8. In the case of medical assessment fee payment, the file shall comply with the provisions of Clause 10 of Article 9 of this Circular.
