On September 6, 2024, the Minister of Justice of Vietnam issued Circular 09/2024/TT-BTP stipulating standards and conditions for the promotion examination of professional titles for legal aid assistants in Vietnam.

According to Article 4 of Circular 09/2024/TT-BTP, the application for registration of examination for promotion of professional titles for legal aid assistants in Vietnam include:

- Public employee curriculum vitae as stipulated in Clause 1, Article 36 of Decree 115/2020/ND-CP (amended according to the provisions at Point c, Clause 38, Article 1 of Decree 85/2023/ND-CP)

The public employee curriculum vitae according to current regulations must be submitted no later than 30 days before the final deadline for submitting the promotion examination dossier of professional titles, with certification from the employing agency or unit of the public employee.

- The appraisal and assessment of the head of the public service provider employing the public employee or the head of the competent authority managing the public service provider as regulated in Clause 2, Article 36 of Decree 115/2020/ND-CP (amended according to the provisions at Point c, Clause 38, Article 1 of Decree 85/2023/ND-CP) according to Form No. 01-TP-TGPL issued with Circular 09/2024/TT-BTP;

- A document confirming a successful litigation participation case as stipulated at Point d, Clause 2, Article 5, or Point d, Clause 2, Article 6 of Circular 05/2022/TT-BTP

In this regard, the Department of Justice sends a written request to the Legal Aid Department for confirmation of the successful litigation participation and a copy of the litigation case file including documents as stipulated in Clause 2, Article 11 of Circular 12/2018/TT-BTP guiding some professional activities for legal aid and managing the quality of legal aid cases.

Within 15 days from the date of receiving the request for confirmation of the successful litigation participation from the Department of Justice, the Legal Aid Department carries out the confirmation of the successful litigation participation according to Form No. 02-TP-TGPL issued with Circular 09/2024/TT-BTP.

In case the requirements are not met, the Legal Aid Department will respond in writing and clearly state the reasons.

- A copy of the recruitment decision, appointment decision to the professional title of legal aid public employee;

- Copies of diplomas and certificates as required:

+ For the promotion to the professional title of legal aid public employee class I, follow the provisions of Article 4 and Point e, Clause 2, Article 5 of Circular 05/2022/TT-BTP;

+ For the promotion to the professional title of legal aid public employee class II, follow the provisions of Article 4 and Point e, Clause 2, Article 6 of Circular 05/2022/TT-BTP;

- A copy of the reward decision by the competent authority (if any).

Cases of special promotion of Professional Titles in Vietnam

- Public employees are considered for special promotion to a higher-ranking professional title when recognized and appointed to a position requiring a higher-ranking professional title than the current one, according to the sector-specific legal provisions and meeting the following standards and conditions:

+ Rated as having completed tasks well or better in the working year immediately preceding the year of examination or promotion; possessing good political and professional ethics; not under disciplinary action, not during the period of implementing the regulations related to public employee discipline as stipulated in Article 56 of Law on Public Employees 2010 (amended and supplemented by Law on Officials and Public Employees Amendment 2019);

+ Having the capacity, professional qualifications, and skills to hold a higher-ranking professional title in the same professional field;

+ Meeting the requirements for diplomas, certificates, and other criteria of the professional title to be promoted;

In case public employees are exempted from foreign language and computer science exams according to Clauses 6 and 7, Article 39 of Decree 115/2020/ND-CP, they must meet the foreign language and computer science standards of the professional title to be promoted;

- The head of the public service provider shall send a written request along with copies of documents proving the standards and conditions for special promotion of the public employee as per the above regulations to the head of the authority managing the public employee for consideration and decision.
