On October 18, 2024, the Minister of Home Affairs of Vietnam issued Circular 11/2024/TT-BNV prescribing the establishment and management of administrative boundary records, which include regulations on the components of administrative boundary records in Vietnam.

Specifically, Circular 11/2024/TT-BNV prescribes the establishment and management of administrative boundary records at the level of provinces and centrally-affiliated cities (hereinafter referred to as provincial level), districts, urban districts, district-level towns, cities under provinces, cities under centrally-affiliated cities (hereinafter referred to as district level), and communes, wards, commune-level towns (hereinafter referred to as commune level).

Regarding the application for appraisal and acceptance of administrative boundary records in Vietnam, Clause 2, Article 4 of Circular 11/2024/TT-BNV provides as follows:

The documents for request appraisal, acceptance, include:

- Proposal document from the Provincial People's Committee.

- Report on results of establishing administrative boundary records.

- administrative boundary records at all levels in paper form (a set number of 01) and in digital form.

- Copies of the Approval Decision along with technical design - cost estimates for establishing administrative boundary records.

- Copies of inspection and acceptance dossiers from the Provincial People's Committee, from the investment decision level and from the construction unit (if any).

- Copies of minutes, documents determining administrative boundary lines on site.

- Document from the Ministry of Natural Resources and Environment of Vietnam on the results of the technical inspection and review of determining administrative boundary lines, marking administrative boundaries, and establishing administrative boundary records at all levels.

- Results of updating national boundary lines in administrative boundary records (if any).

Regulations on completing administrative boundary records in Vietnam

- Based on the original field administrative boundary maps signed and confirmed by the People's Committees of the relevant administrative units, the Provincial People's Committee organizes the completion of administrative boundary records according to the regulations in this Circular and the legal provisions on techniques for determining administrative boundary lines, marking boundaries, and establishing administrative boundary records at all levels.

- Duplication and confirmation of administrative boundary records

After the administrative boundary records at all levels are completed, the Provincial People's Committee organizes sufficient duplication as prescribed and signs for confirmation as follows:

+ Commune-level administrative boundary records include 05 sets, signed by the Commune People's Committee and confirmed by the District People's Committee. For the map confirmation signature of district-level administrative boundary markers on commune-level administrative boundary lines, the District People's Committee signs and the Provincial People's Committee confirms; for the map confirmation signature of provincial-level administrative boundary markers on commune-level administrative boundary lines, the Provincial People's Committee signs.

+ District-level administrative boundary records include 04 sets, signed by the District People's Committee and confirmed by the Provincial People's Committee.

+ Provincial-level administrative boundary records include 03 sets, signed by the Provincial People's Committee.

(Clause 4, Article 3 of Circular 11/2024/TT-BNV)

Regulations on management and storage of administrative boundary records in Vietnam

(1) The Provincial People's Committee submits 01 set of administrative boundary records to the State's historical archives at the central level at the Ministry of Home Affairs.

(2) For the remaining administrative boundary records, the Provincial People's Committee proceeds to hand over for management, exploitation, and use in accordance with the laws on archives as follows:

- Provincial-level administrative boundary records are handed over to the Ministry of Natural Resources and Environment and the Provincial People's Committee.

- District-level administrative boundary records are handed over to the Ministry of Natural Resources and Environment, the Provincial People's Committee, and the District People's Committee.

- Commune-level administrative boundary records are handed over to the Ministry of Natural Resources and Environment, the Provincial People's Committee, the District People's Committee, and the Commune People's Committee.

More details can be found in Circular 11/2024/TT-BNV which comes into force in Vietnam from October 18, 2024.
