Application for assistance for artels, cooperatives, cooperative unions in Vietnam

The content is guided by Decision 2373/QD-BKHDT in 2024 announcing new administrative procedures in the field of support for cooperatives, cooperative unions under the management scope of the Ministry of Planning and Investment of Vietnam.

Accordingly, the guidance on the application for assistance for artels, cooperatives, cooperative unions in Vietnam is as follows:

1. Order of Execution:

The cooperative, cooperative union sends one set of registration documents for support needs to the People's Committee of the commune where the cooperative has its transaction address or where the cooperative union has its headquarters.

2. Method of Execution:

The registration application is submitted to the People's Committee of the commune by one of the following methods:

- Direct submission;

- Via public postal service;

- Online through the National Information System on Cooperatives (when completed) / National Public Service Portal.

3. Components of the application:

* The registration application for support needs includes:

- A registration form for support needs including a commitment to not violate prohibited acts as stipulated in Clause 2, Article 7 of the Cooperative Law 2023, not being under execution of a criminal judgment of the Court that has taken legal effect according to Form No. 01 in the Appendix issued with Decree 113/2024/ND-CP dated September 12, 2024;

- Copies of documents and applications proving compliance with the benefiting criteria as prescribed:

For cooperatives and cooperative unions in Vietnam:

+ Documents and applications proving that cooperatives, cooperative unions meet one (mandatory) or multiple (if any) of the following criteria, particularly: increase in the number of members in two consecutive years leading to the year of registration for support needs; the increase rate of internal transaction value in the year before the registration for support needs; the rate of common fund set aside higher than the minimum level prescribed in Article 84 of the Cooperative Law 2023 in the year before the registration for support needs; increase in common undivided assets value in the year before the registration for support needs; at least 5% of the total members and employees are engaged in education, training, dissemination, enhancement, and rehearsal organized by cooperatives, cooperative unions themselves or by other agencies, organizations, and are certified for course participation or have a list of members, employees attending the course with a seal of the cooperative, cooperative union (for courses organized by the cooperative, cooperative union themselves, they must have a plan for organizing the course, course content, and a list of the course signed by the course participants) as of the year before the registration for support needs; established not more than 36 months in socio-economic, challenging or especially challenging localities according to legal regulations on investment as of the time of registration for support needs;

+ If cooperatives, cooperative unions register for benefit of support from the state budget valued at 3 billion VND or more, they must have an audited financial statement of the previous year by an independent auditing organization at the time of registration for support needs.

For artels:

+ A copy of the Certificate of Cooperative Group Registration;

+ Documents and applications proving that artels meet one (mandatory) or multiple criteria (if any), specifically: increase in the number of members in two consecutive years leading to the year of registration for support needs; at least 5% of the total members and employees have participated in education, training, dissemination, enhancement, and rehearsal organized by the cooperative group itself or by other agencies, organizations, certified for course participation or have a list of members, employees attending the course with verification of the cooperative group (for courses organized by the cooperative group itself, they must have a plan for organizing the course, course content, and list of course signed by the course participants) as of the year before the registration for support needs; established not more than 36 months in socio-economic challenging or especially challenging localities according to legal regulations on investment as of the time of registration for support needs.

The cooperative, cooperative group, or cooperative union is fully responsible before the law for the accuracy, truthfulness of the information provided in the registration application for support needs mentioned above.

4. Number of applications: 01 set.

5. Time Limit for Resolution: 10 working days from the date of receipt of a valid application.
