Circular 85/2018/TT-BQP issued by the Ministry of National Defense on June 23, 2018, stipulating the management of industrial explosives and explosive precursors. Notably, the regulation on the application dossier for the permit of industrial explosives.
Circular 85 stipulates that organizations and enterprises that meet the legal requirements when applying for a License for the Use of Industrial Explosives must submit the following documents:
- Application for a License for the Use of Industrial Explosives;- A copy of the decision to establish the unit or a copy of the effective Enterprise Registration Certificate;- A copy of the Security and Order Certification for the enterprise. The Security and Safety Certification is issued by the security protection agency in accordance with Form No. 06 in the Appendix issued with this Circular for military units that are not enterprises;- A copy of the license for mineral and petroleum exploration and exploitation for enterprises engaged in mineral and petroleum activities; a copy of the decision to award the construction contract, a copy of the contract of undertaking or an authorization letter, assigns the task to perform the construction contract of the enterprise management organization; a copy of the assignment document of the agency or unit under the Ministry of Defense for other tasks requiring the use of industrial explosives;- A copy of the design, construction drawings of construction works utilizing industrial explosives for industrial-scale projects; the construction and exploitation plan for manual construction and exploitation activities. The design or plan approved by the investor must ensure safety conditions according to technical standards and regulations;- The blasting design or plan approved by the leader of the organization or enterprise;
In case of blasting in residential areas, medical examination and treatment facilities, areas with historical-cultural relics, nature reserves, security, defense works, or other important national works, and other protected areas as prescribed by law, written approval from the provincial People's Committee or the managing authority is required. Additionally, the blasting design or plan must be approved by the agency issuing the License for the Use of Industrial Explosives.
- A copy of the acceptance or periodic inspection document regarding fire prevention and fighting for the industrial explosives warehouse and safety assurance conditions according to technical standards and regulations;- In case the organization or enterprise applying for the License for the Use of Industrial Explosives does not have a warehouse or transportation means, the application dossier must include a copy of the principle contract for renting a warehouse, transportation means for industrial explosives with an organization or enterprise that has a warehouse, transportation means ensuring safety conditions according to technical standards and regulations, fire prevention, and fighting, or a copy of the principle contract with an organization licensed to trade industrial explosives to supply industrial explosives to the construction site according to the blasting passport;- Decision of appointment for the blasting commander by the unit commander or enterprise leader and the list of blasters, persons assigned to manage the industrial explosives warehouse, and service personnel (security, loading and unloading, and transportation at the warehouse, transit point, and blasting site); work permits for foreign workers involved in the use of industrial explosives (if any); a copy of the professional certificates and safety training certificates on the use of industrial explosives for the blasting commander, blasters, warehouse keepers, and service personnel;- A copy of the document proving the payment of appraisal fees for licensing as prescribed;- Authorization letter enclosed with a copy of the officer identity card or military identity card (for military personnel), ID card, citizen identification card, or passport of the person submitting the application in person.
