Regarding this matter, LawNet would like to answer as follows:

The Ministry of Labor - Invalids, and Social Affairs has recently submitted a draft proposal to the Government for the construction of the amended Law on Employment. Specifically, the proposed amendments focus on the regulations related to labor market information systems. The documents of the 13th National Party Congress emphasized the need to "focus on building and improving labor market information systems." Resolution 42-NQ/TW in 2023 sets forth tasks and solutions for "modernizing and digitizing market forecasting information, connecting supply and demand, managing human resources, and building labor and employment databases."

Amendments to regulations on labor market information systems in Vietnam (Proposal)

Currently, the Law on Employment 2013 sets out the content of labor market information, including employment status and trends; information on labor supply and demand; labor market fluctuations; information on foreign workers working in Vietnam and Vietnamese guest workers; and information on wages and salaries.

However, there are currently no regulations on the definition and functions of labor market information systems. Labor market information is collected and compiled from various sources and by different organizations and individuals, each with different objectives. This information is not centralized and stored for shared exploitation and management.

Additionally, current regulations in the Law do not clearly define the roles and responsibilities of relevant agencies (the Ministry of Labor - Invalids and Social Affairs, statistical agencies, local People's Committees) in collecting, compiling, analyzing, forecasting, and disseminating labor market information.

The draft amendment to the Law on Employment proposes to amend and supplement regulations on labor market information systems as follows:

(1) Define the concept and functions of labor market information systems as follows:

- Labor market information systems are a network of organizations, institutions, processes, and tools established to collect, compile, store, analyze, forecast, and disseminate labor market information for the purpose of serving management, research, policy planning, and supporting organizations and individuals participating in the labor market.

- The functions of labor market information systems include:

+ Collecting, verifying, and compiling labor market information;

+ Analyzing the labor market, monitoring, and evaluating the implementation of labor and employment policies;

+ Sharing, disseminating, and exchanging information.

(2) Amend regulations on the roles and responsibilities of relevant agencies in the construction and development of the labor market information system to serve management, research, policy planning, and support for organizations and individuals participating in the labor market, ensuring consistency and conformity with statistical laws and regulations on national databases and other specialized databases.

The management of labor market information systems is as follows:

- The Ministry of Labor - Invalids, and Social Affairs is responsible for coordinating with relevant agencies in the construction, operation, and management of labor market information systems.

- Provincial People's Committees are responsible for constructing and operating provincial-level labor market information systems and managing labor market information systems within their jurisdictions.

- The state statistical agency is responsible for collecting, publishing, and building and managing databases for labor market information that falls within the national statistical indicators and other labor market information as provided by statistical laws.
