Amendments to regulations on declaration of temporary residence in Vietnam

According to Clause 5, Article 2 of the Law on amendments to some articles of law on entry and exit of Vietnamese citizens and law on entry, exit, transit and residence of foreigners in Vietnam amending Article 33 of the Law on entry, exit, transit and residence of foreigners in Vietnam, declaration of temporary residence is as follows:

- Any foreigner that temporarily resides in Vietnam shall, via the person directly managing and operating the operation of the accommodation establishment, declare his/her temporary residence to the police of the commune, ward, and township or at the local police authority/station where the accommodation establishment is located.

+ Accommodation establishments shall be responsible for requesting foreigners to present their passports or international travel documents, and documents related to residence in Vietnam to register temporary residence before admitting them.

+ If the border guard post/station receives the declaration of temporary residence of a foreigner under regulations of an international treaty to which Vietnam is a signatory, the border guard post/station shall immediately notify the police of the commune, ward, township or the police authority/station where the foreigner temporarily resides.

- The declaration of temporary residence of foreigners can be sent to the police in either electronic or paper form.

+ In case of applying for temporary residence in the paper form, the person directly managing and operating the operation of the accommodation establishment shall be responsible for filling in all information about the foreigner on the temporary residence declaration form and sending it to the police of the commune, ward, township or the police authority/station where the accommodation establishment is located within 12 hours (24 hours for remote areas) from the time the foreigner arrives at the accommodation establishment. 

- In case where foreigners change their address of temporary residence stated in their permanent residence cards or when there is any change in information in their passports, the declaration of temporary residence must be remade as prescribed in Clause 1 of Article 33 of the Law on entry, exit, transit and residence of foreigners.

Signing up for declaration of temporary residence in Vietnam

Pursuant to Article 4 of Circular 53/2016/TT-BCA, signing up for declaration of temporary residence in Vietnam on website as follows:

- Declarant of temporary residency shall access the website of the immigration office of the police department of the province or central-affiliated city where the relevant accommodation establishment is located (referred to as the website) and input the name, type, address, telephone number and email address of the accommodation establishment and the declarant’s name, date of birth, telephone number, ID card number or citizenship identity card number or passport number to obtain a declaration account.

+ Changes to the information concerning the declaration account shall be updated promptly on the website.

- Declarant of temporary residency shall be responsible for managing and securing the password and all information ensuing from the declaration account. If the declaration is stolen, abused or not accessible, such incident shall be reported promptly to the immigration office of the provincial police department.

+ The declaration account shall be automatically terminated when the declared information is not updated in 12 months, is untrue or contains inaccurate details on the foreigner or accommodation establishment.

Pursuant to the provisions of Article 5 of Circular 53/2016/TT-BCA on declaration of temporary residency as follows:

- Declarant of temporary residency shall access the website and log on the declaration account to declare the information on temporary residency. The declaration of a foreigner's temporary residency on the website shall proceed immediately upon the foreigner’s registration of temporary residency.

- The declared information on temporary residency includes the foreigner’s full name, gender, date of birth, nationality, passport number or equivalent paper, and expected duration of temporary residency. The information shall be entered into relevant fields or into the sample input file available on the website.

- The declarant shall examine and revise the information before saving it. In addition, the declarant shall check the section of temporary residency information management to confirm the system’s acknowledgement and re-input the information that is yet acknowledged.
