Amendment to the Regulations on the Selection of Water Supply Units in the Area

According to the regulations, the water supply unit may choose and be chosen as the investor for one, several, or all components of the water supply system, from extraction works, water treatment plants, Level I network, Level II network to Level III network, to conduct wholesale and retail clean water business.

At Clause 5, Article 1 of Decree 98/2019/ND-CP amending and supplementing Article 29 of Decree 117/2007/ND-CP, it is stipulated that for areas where there are already organizations or individuals providing water supply services, such organizations or individuals will continue to provide water supply services in the area.

Additionally, for areas without a water supply unit providing services or areas needing to change the water supply unit due to failure to meet service quality requirements and water supply development plans, the selection of the water supply unit to invest in building the water supply system and clean water business in the area is conducted according to the regulations on bidding and the specific conditions of each locality.

Decree 98 emphasizes that the provincial People's Committee or the agency decentralized by the provincial People's Committee (hereafter referred to as the People's Committee) will organize the selection of the water supply unit, with the participation of localities within the water supply area.

Moreover, the Ministry of Construction organizes the selection of the water supply unit for urban and industrial water supply projects with an inter-provincial scope, with the participation of the relevant provinces; the Ministry of Agriculture and Rural Development organizes the selection of the water supply unit for rural water supply projects with an inter-provincial scope, with the participation of the relevant provinces.
