Organizational structure of the Ministry of Justice of Vietnam from March 1, 2025

According to Article 3 of Decree 39/2025/ND-CP, the organizational structure of the Ministry of Justice includes the following entities:

The following organizations are administrative entities assisting the Minister in performing state management functions:

- Department of Legislative Document Drafting.

- Department of Criminal and Administrative Law.

- Department of Civil and Economic Law.

- Department of International Law.

- Department of Personnel Organization.

- Department of International Cooperation.

- Inspectorate of the Ministry.

- Office of the Ministry.

- Department for the Management of Civil Judgment Execution.

- Department for Document Examination and Management of Administrative Violation Handling.

- Department for Legal Dissemination, Education, and Legal Aid.

- Department of Judicial Administration.

- Department of Secured Transactions Registration and State Compensation.

- Department of Judicial Support.

- Department of Planning and Finance.

- Department of Information Technology.

The following organizations are public service providers serving state management under the Ministry:

- Institute of Strategy and Legal Science.

- Judicial Academy.

- Journal of Democracy and Law.

- Vietnam Law Newspaper.

The Department of Legislative Document Drafting has 03 divisions, Department of Criminal and Administrative Law has 03 divisions, Department of Civil and Economic Law has 04 divisions, Department of International Law has 04 divisions, Department of Personnel Organization has 05 divisions, Department of International Cooperation has 03 divisions.

The Minister of Justice stipulates the functions, tasks, powers, and organizational structure of units under the ministry and submits to the Prime Minister the list of other public service providers under the ministry.

Some agencies are removed from the organizational structure of the Ministry of Justice of Vietnam

The organizations mentioned in Article 3 of Decree 98/2022/ND-CP are removed from the organizational structure of the Ministry of Justice according to Article 3 of Decree 39/2025/ND-C:

- Department of Adoption.

- General Department of Civil Judgment Execution. (Now changed to Department for the Management of Civil Judgment Execution)

- Department for Legal Dissemination and Education. (Merged with Legal Aid Department)

- Department for Examination of Legislative Documents. (Merged with Department for the Management of Administrative Violation Handling and Law Enforcement Monitoring)

- Department for the Management of Administrative Violation Handling and Law Enforcement Monitoring (Merged with Department for Examination of Legislative Documents)

- Department of Civil Status, Nationality, and Authentication.

- Legal Aid Department. (Merged with Department for Legal Dissemination and Education)

- National Registration Department of Secured Transactions. (Merged with Department of State Compensation)

- Department of State Compensation. (Merged with National Registration Department of Secured Transactions)

- National Judicial Record Center.

Duties and powers of the Ministry of Justice of Vietnam

According to Article 2 of Decree 39/2025/ND-CP, the duties and powers of the Ministry of Justice are stipulated as follows:

(1) Submit to the Government of Vietnam projects and resolutions of the National Assembly, ordinance projects, and resolutions of the Standing Committee of the National Assembly; draft decrees and resolutions of the Government of Vietnam; drafts decisions of the Prime Minister in areas under the management scope according to annually approved legislation programs and plans and other projects and schemes as assigned by the Government of Vietnam, Prime Minister.

(2) Submit to the Government of Vietnam, Prime Minister strategies, planning, long-term development programs, 5-year, annual plans, and important national projects; submit to the Prime Minister drafts decision, directives on areas under the state management scope of the ministry.

(3) Issue circulars, decisions, directives and other documents within the state management scope of the ministry.

(4) Direct, monitor, guide professionally, inspect, and organize the implementation of legislative documents, strategies, planning, programs, plans, projects, schemes that have been approved within the state management scope of the ministry.

(5) Direct and organize the implementation of information technology application, digital transformation; develop digital infrastructure and ensure network security and information safety; build electronic government, digital government; manage, develop, connect, share and exploit data, information in areas under the state management scope of the ministry as per legal regulations.

(6) Implement legal construction work.

(7) Implement the organization of law enforcement.

(8) Implement civil judgment execution and administrative judgment execution.

(9) Implement judicial administration.

(10) Implement judicial support.

(11) Implement legal affairs.

(12) Implement the construction of institutions, international law, and resolve international investment disputes.

(13) Implement international cooperation on law and judicial reform.

(14) Implement administrative reform.

(15) Issue, manage, and guide the uniform use of forms, papers, and books in areas under the state management scope of the ministry according to legal regulations; perform reporting, statistics, archiving documents, data on state management areas of the ministry as per legal regulations.

(16) Manage associations, non-governmental organizations, public service provision in areas under the state management scope of the ministry according to legal regulations.

(17) Conduct inspection, solving complaints, denunciations, citizen reception, anti-corruption, waste, and negative acts, and handling legal violations in areas under the state management scope of the ministry according to legal regulations.

(18) Direct and organize scientific research, development, and application of scientific research results in areas under state management scope of the ministry.

(19) Organize legal training and training, fostering judicial positions, judicial support as per legal regulations.

(20) Manage organizational structure, job positions, payroll, officials and public employees, laborers, and implement salary policies, other policies, preferential policies, commendation, discipline, professional, skill training for officials and public employees, laborers under the management of the ministry as per legal regulations.

(21) Manage finances, assets, allocated public investment, and organize implementation as per legal regulations.

(22) Perform other duties, powers assigned by the Government of Vietnam, Prime Minister and as per legal regulations.
