Amendment on Determining Training Volume for Each Type of Car Driving License

Recently, the Minister of Transport has signed and issued Circular 38/2019/TT-BGTVT amending and supplementing a number of articles of Circular 12/2017/TT-BGTVT on regulations for training, testing, and issuing road motor vehicle driver's licenses.

According to the provisions of Clause 2, Article 3 of Decree 65/2016/ND-CP, the training capacity for automobile driving is understood as the maximum number of learners that a facility is permitted to train at one time. This is determined by the total number of learners being trained for various types of driving licenses, including both theoretical and practical learners at the time of determining the training capacity.

Driving training facilities must comply with the regulations on training capacity. The method for determining the training capacity for each type of automobile driving license is implemented according to the guidance in Clause 2, Article 1 of Circular 38/2019/TT-BGTVT, amending and supplementing Clause 3, Article 4 of Circular 12/2017/TT-BGTVT as follows:

- The training capacity is determined based on the number of classrooms and driving practice yards specified in Decree 65/2016/ND-CP dated July 1, 2016, of the Government of Vietnam, which regulates the business conditions for automobile driving training services and driving test services, and Decree 138/2018/ND-CP dated October 8, 2018, of the Government of Vietnam, which amends and supplements several articles of Decree 65/2016/ND-CP.- The training facility must ensure that the number of practical learners for each type of driving license does not exceed the capacity to meet the number of practice vehicles of the training facility.

Moreover, Circular 12/2017/TT-BGTVT also stipulates that driving training facilities for categories A1, A2, A3, and A4 must notify the training operation plans to the local Department of Transport where the training is organized to carry out supervision and management.
