All penalty levels related to blood alcohol concentration in 2025 in Vietnam

(1) Penalty levels related to blood alcohol concentration in 2025 for automobile operators in Vietnam

The penalty levels related to blood alcohol concentration in 2025 for automobile operators will be applied according to the provisions of Article 6 Decree 168/2024/ND-CP. To be specific:

- Not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath: Fines from 6 to 8 million VND and Deduction of 04 points from the driver license.

- Exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath: Fines from 18 to 20 million VND and Deduction of 10 points from the driver license.

- Exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath: Fines from 30 to 40 million VND and Revocation of driver license for 22 to 24 months.

(2) Penalty levels related to blood alcohol concentration in 2025 for motorcycle operators in Vietnam

According to Article 7 Decree 168/2024/ND-CP, the penalty levels related to blood alcohol concentration in 2025 for motorcycle operators are regulated as follows:

- Not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath: Fines from 2 to 3 million VND and Deduction of 04 points from the driver license.

- Exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath: Fines from 6 to 8 million VND and Deduction of 10 points from the driver license.

- Exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath: Fines from 8 to 10 million VND and Revocation of driver license for 22 to 24 months.

(3) Penalty levels related to blood alcohol concentration in 2025 for special-use motor vehicle operators in Vietnam

Unlike automobiles and motorcycles, the penalty levels related to blood alcohol concentration in 2025 for special-use motor vehicle operators only apply monetary fines with specific levels as follows:

- Not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath: Fines from 3 to 5 million VND.

- Exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath: Fines from 6 to 8 million VND.

- Exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath: Fines from 18 to 20 million VND.

(4) Penalty levels related to blood alcohol concentration in 2025 for bicycle operators in Vietnam

According to Article 9 Decree 168/2024/ND-CP, the penalty levels related to blood alcohol concentration in 2025 for bicycle operators are regulated as follows:

- Not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath: Fines from 100,000 VND to 200,000 VND.

- Exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath: Fines from 300,000 VND to 400,000 VND.

- Exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath: Fines from 400,000 VND to 600,000 VND.

Principles of deducting points from driver license in Vietnam from January 1, 2025

- The deduction of points from a driver license is carried out immediately after the decision on administrative penalty for violations which according to Decree 168/2024/ND-CP requires deducting points from the driver license takes effect;

- In the case where an individual commits multiple administrative violations or repeated administrative violations and is penalized at the same time, if there are 02 or more violations requiring points deduction from the driver license, points will only be deducted for the violation with the highest point deduction;

- If the remaining points on the driver license are less than the points to be deducted, the remaining points of that driver license will be deducted in full;

- If a driver license integrates both an unlimited-term license (motorcycles, similar vehicles) and a limited-term license (automobiles, similar vehicles, four-wheel motorized passenger vehicles, four-wheel cargo vehicles), the authorized person shall deduct points from the unlimited license when the operator drives a motorcycle or similar vehicle, or deduct points from the limited license when the operator drives a car, similar vehicle, four-wheel motorized passenger vehicle, or four-wheel cargo vehicle, for administrative violations requiring license point deduction;

- No points are deducted from the driver license if the driver license is under suspension.
