According to the provisions of the Labor Code 2012, employees are entitled to take leave and receive full pay (without salary reduction) in the following cases.
Based on Articles 111, 112, 115, 116 of the 2012 Labor Code, cases in which employees are entitled to leave and full pay include:
- New Year's Day: 1 day off (January 1, 2019)
- Lunar New Year: 5 consecutive days off (1 day at the end of the year and 4 days at the beginning of the year or 2 days at the end of the year and 3 days at the beginning of the Lunar year)
- Victory Day: 1 day off (April 30, 2019)
- International Labor Day: 1 day off (May 1, 2019)
- National Day: 1 day off (September 2, 2019)
- Hung Kings' Festival: 1 day off (the 10th day of the 3rd Lunar month)
- Marriage: 3 days off
- Child's marriage: 1 day off
- Biological parent passes away: 3 days off
- Parent-in-law passes away: 3 days off
- Spouse passes away: 3 days off
- Child passes away: 3 days off
- Annual leave (12 days/year for employees working for 12 months or more) and additional annual leave according to seniority.
Additionally, pursuant to Clause 9, Article 1 of Decree 148/2018/ND-CP, the salary used as the basis for paying employees on the aforementioned days off is the salary according to the labor contract divided by the number of normal working days in the month as prescribed by the employer, multiplied by the number of annual leave days, additional annual leave days according to seniority, holidays, Tet, and personal leave with pay.
