For each profession, there is a specific age limit for service, and the People's Public Security is no exception. So, how does Vietnamese law regulate the service age for a specialized field like officers in the People's Public Security?
1. Age Limits for Service of People’s Public Security Officers
According to Article 29 of the People’s Public Security Law 2014 and Article 10 of Decree 103/2015/ND-CP, the maximum service age for People’s Public Security officers by rank is as follows:
- Junior Officer: Male 53, Female 53;- Major, Lieutenant Colonel: Male 55, Female 53;- Senior Colonel: Male 58, Female 55;- Colonel: Male 60, Female 55;- General Rank: Male 60, Female 55.
In cases where the security unit has a need, officers specified in Points a, b, and c of Clause 1, Article 29 of the People’s Public Security Law 2014, if they are of good character, proficient in their profession, in good health, and voluntarily wish to continue service, may have their service age extended as per the regulations of the Minister of Public Security, but not beyond 60 for males and 55 for females.
Officers who are professors, associate professors, doctors, senior experts, and female officers with the rank of general may have their service age extended beyond 60 for males and more than 55 for females according to the regulations of the Government of Vietnam; in special cases, extensions may be granted as per the decision of the President.
2. Conditions and Duration for Extending Service Age of People’s Public Security Officers who are Professors, Associate Professors, Doctors, Senior Experts, and Female Officers with the Rank of General
Pursuant to Article 11 of Decree 103/2015/ND-CP, People’s Public Security officers who are professors, associate professors, doctors, and senior experts may have their service age extended when they meet the following conditions:
- The unit directly utilizing the officer or another unit within the People’s Public Security has a genuine need;- The officer is in good health, possesses good qualities, professional capability, and voluntarily wishes to continue working as required.
People’s Public Security officers who are professors, associate professors, doctors, and senior experts may have their service age extended for teaching, scientific research, and technology at universities, and research institutes within the People’s Public Security. The extension period is as follows:
- Not exceeding 10 years for professors;- Not exceeding 7 years for associate professors;- Not exceeding 5 years for doctors and senior experts.
Female People’s Public Security officers holding the rank of general will have their service age extended and will retire as per Decree No. 53/2015/ND-CP.
During the extended service period, those granted an extension may request to retire and enjoy retirement policies according to regulations.
In special cases, the decision to extend the service age beyond the provisions of Clauses 2 and 3 of Article 29 of the People’s Public Security Law 2014 is made by the President.
The order and procedures for extending the service age of People’s Public Security officers are defined by the Minister of Public Security.
3. Regimes and Policies for Officers with Extended Service Age
According to Article 12 of Decree 103/2015/ND-CP, during the extended service period, People’s Public Security officers will cease to hold leadership and command positions (except for female officers with the rank of general whose service age is extended as per Decree No. 53/2015/ND-CP).
Officers with extended service age will receive salaries and other policies according to current regulations.
4. Authority for Deciding on the Extension of Service Age for People’s Public Security Officers
Regarding the authority for deciding on the extension of the service age of People’s Public Security officers, the law provides as follows:
- The consideration for extending the service age of People’s Public Security officers with the rank of Major General and positions from Head of General Department or higher, will be presented by the Minister of Public Security to the competent authority as per personnel management hierarchy for a decision.- The consideration for extending the service age of People’s Public Security officers with the rank of Colonel and positions from Deputy Head of General Department or below, will be decided by the Minister of Public Security.- In special cases, the extension of the service age of People’s Public Security officers will be proposed by the Minister of Public Security for the President’s review and decision.
These are the contents stipulated in Article 13 of Decree 103/2015/ND-CP.
