This is the content stipulated in Circular 28/2017/TT-BYT issued by the Ministry of Health on June 28, 2017.
Accordingly, the advance, payment and settlement with the contractor winning the bid to supply HIV drugs are regulated in Circular 28 as follows:
- Based on the quantity of drugs supplied by the contractor quarterly and reports on the distribution and use of drugs in provinces and cities, the Contracting Unit shall transfer funds for the purchase of drugs for each quarter, ensuring that the total advance funds for the year do not exceed 80% of the drug costs used in the year. At the end of the contract term, the Contracting Unit and the contractor will liquidate the contract in accordance with the current laws and the terms of the framework agreement, signed contract;- HIV drugs in stock (stocks at the contractor, stocks at medical facilities) by the end of the year will be carried over to the following year for use and deducted from the drug purchase plan for the following year;- The health insurance fund only advances, and settles the costs of HIV drugs directly used for HIV-infected people with health insurance cards. In case of drugs being lost, damaged, or expired due to the contractor's fault, if the contractor has received full payment, they must return this amount to the Contracting Unit.
