Adopting Foreign Standards and International Standards on Fire Prevention and Fighting

The application of foreign standards, international standards on fire prevention and fighting is regulated in Decree 78/2011/ND-CP which stipulates the coordination between the Ministry of Public Security and the Ministry of Defense in organizing the implementation of fire prevention and fighting tasks for defense establishments, issued on September 1, 2011.

To be specific, the appraisal of fire prevention and fighting is stipulated in Decree 78/2011/ND-CP as follows:

  1. The Ministry of Public Security is responsible for directing the organization to appraise, inspect the construction and acceptance of fire prevention and fighting for defense facilities serving socio-economic activities and motor vehicles with special requirements for ensuring fire safety and firefighting safety, which are specially manufactured or modified for socio-economic activities.

  2. The Ministry of National Defense shall take the lead and cooperate with the Ministry of Public Security to implement safety conditions for fire prevention and firefighting in managing investment in construction as prescribed by the law on fire prevention and fighting for defense facilities serving military purposes and motor vehicles with special requirements for ensuring fire safety and firefighting safety, which are manufactured or modified by defense facilities for military activities.

  3. The application of foreign standards, international standards on fire prevention and fighting in designing and constructing defense facilities shall follow the provisions in Clause 3, Article 6 of Decree No. 35/2003/ND-CP dated April 4, 2003, of the Government of Vietnam detailing the implementation of certain articles of the Law on Fire Prevention and Fighting (hereinafter referred to as Decree No. 35/2003/ND-CP).

Further, the Ministry of Public Security takes the lead and cooperates with the Ministry of National Defense to inspect fire safety for defense facilities serving socio-economic activities according to the policies and contents stipulated in Article 19 of Decree No. 35/2003/ND-CP.

In addition, the Ministry of National Defense is responsible for directing the implementation of:

- Ensuring safety conditions for fire prevention and fighting as prescribed by the law on fire prevention and fighting for defense facilities serving military purposes and special motor vehicles serving military purposes which require ensuring fire safety and firefighting safety.

- Inspecting fire safety for defense facilities serving military purposes according to the policies and contents stipulated in Article 19 of Decree No. 35/2003/ND-CP. Annually, a plan shall be established to cooperate with the Ministry of Public Security in inspecting fire safety for these facilities. To ensure national defense secrecy, individuals participating in the inspections must be authorized by competent authorities of both Ministries.
