On June 28, 2024, the Ministry of Labor - Invalids and Social Affairs (Hanoi, Vietnam) issued Decision 860/QD-BLDTBXH on the announcement of new and annulled internal administrative procedures within the State administrative system, under the management scope of the Ministry of Labor - Invalids and Social Affairs (internal central-level administrative procedures).
Administrative procedure for "Determining poor districts in the period of 2021-2025" in Vietnam
(1) Sequence of Implementation
- The district-level People's Committee prepares 02 sets of documents as prescribed at point a, clause 1 and clause 3 of Article 5 Decision 36/2021/QD-TTg, and submits them to the provincial-level People's Committee.
- Within 15 days from the date of receipt of the complete documents from the district-level People's Committee, the provincial-level People's Committee reviews, verifies, and prepares the documents as prescribed at point b, clause 1, and clause 3 of Article 5 Decision 36/2021/QD-TTg, and submits them to the Ministry of Labor - Invalids and Social Affairs. In case the documents do not comply with the regulations, the provincial-level People's Committee will issue a written response, stating the reasons.
- Within 30 days from the date of receipt of the complete documents from the provincial-level People's Committee, the Ministry of Labor - Invalids and Social Affairs (Hanoi, Vietnam) consolidates and verifies the information; based on the allocation capability of resources, it drafts a list of poor districts with a total score of 100 or lower according to the criteria system for determining poor districts stipulated in Appendix I issued with Decision 36/2021/QD-TTg and the priority order according to the criteria for determining poor districts regulated at Article 3 Decision 36/2021/QD-TTg, and submits it to the Prime Minister for consideration and decision.
(2) Method of Implementation: Submit the documents via the document interchange network, postal service, or directly.
(3) Composition and Number of Documents
(3.1) Documents from the district-level People's Committee
- Composition of documents
+ The proposal of the district-level People's Committee requesting the determination of a poor district.
+ The report from the district-level People's Committee on the achievement levels of the criteria set out in Article 3 Decision 36/2021/QD-TTg and the accompanying evidential materials and data.
- Number of documents: 02 sets.
(3.2) Documents from the provincial-level People's Committee
- Composition of documents
+ The proposal of the provincial-level People's Committee requesting the determination of poor districts.
+ The consolidated report and evaluation from the provincial-level People's Committee on each district according to the criteria set out in Article 3 Decision 36/2021/QD-TTg and the accompanying evidential materials and data.
+ The list of poor districts as suggested by the provincial-level People's Committee.
+ The verification report from the Department of Labor - Invalids and Social Affairs.
+ The decision approving the results of the review of poor and near-poor households from the provincial-level People's Committee, detailed by district.
+ 01 original set of documents from the district-level People's Committee mentioned above.
- Number of documents: 01 set.
(4) Time Limit for Resolution
- Within 15 days from the date of receipt of the complete documents from the district-level People's Committee, the provincial-level People's Committee reviews, verifies, and prepares the documents as prescribed at point b, clause 1, and clause 3 of Article 5 Decision 36/2021/QD-TTg, and submits them to the Ministry of Labor - Invalids and Social Affairs. In case the documents do not comply with the regulations, the provincial-level People's Committee will issue a written response, stating the reasons.
- Within 30 days from the date of receipt of the complete documents from the provincial-level People's Committee, the Ministry of Labor - Invalids and Social Affairs consolidates and verifies the information; based on the allocation capability of resources, it drafts a list of poor districts with a total score of 100 or lower according to the criteria system for determining poor districts stipulated in Appendix I issued with Decision 36/2021/QD-TTg and the priority order according to the criteria for determining poor districts regulated at Article 3 Decision 36/2021/QD-TTg, and submits it to the Prime Minister for consideration and decision.
- Time to submit to the Prime Minister for consideration and decision: Implement according to the working regulation of the Government of Vietnam.
