Regarding this issue, LawNet would like to answer as follows:
On March 12, 2024, the Prime Minister issued Decision 227/QD-TTg adjusting land use indicators by 2025, which was allocated by the Prime Minister in Decision 326/QD-TTg on March 9, 2022.
Decision 227/QD-TTg specifies that the adjustment of some land use indicators by 2025 for provinces and centrally governed cities and the Ministry of Public Security will not change the objectives, spatial orientation, vision, land use indicators, and projects that have been identified in the provincial planning for the period of 2021–2030 and the vision until 2050.
Based on the land use indicators allocated in Decision 227/QD-TTg, the Minister of National Defense, the Minister of Public Security, and the People's Committees of provinces and centrally governed cities (referred to as provincial level) shall implement the following:
- The Minister of National Defense and the Minister of Public Security shall urgently complete the planning of land use for defense purposes for the 5-year period of 2021-2025 and the planning of land use for security purposes for the 5-year period of 2021-2025.
- The People's Committees at the provincial level shall urgently complete the planning of land use for the 5-year period of 2021-2025 at the provincial level, ensuring compliance with the allocated land use indicators and consistency with the planning and land use plans of all levels.
- The Ministry of Natural Resources and Environment shall monitor, update changes, evaluate the implementation results, inspect the implementation of planning and land use plans, summarize reports and propose to the Government and the Prime Minister for flexible adjustments of indicators between localities with unused or inefficiently used land for localities with investment opportunities and efficient utilization of land resources for sustainable socio-economic development and environmental protection; take charge, coordinate with relevant ministries and agencies to synthesize and advise the Government to submit to the National Assembly for adjustments of the land use planning and plans until 2030.
The adjustments to some land use indicators by 2025 are as follows:
- For Dien Bien province, the adjusted land use indicators by 2025 are as follows:
+ Agricultural land: 893,853 ha;
+ Non-agricultural land: 31,662 ha, including security land: 458 ha.
- For Lai Chau province, the adjusted land use indicators by 2025 are as follows:
+ Agricultural land: 668,918 ha;
+ Non-agricultural land: 44,166 ha, including security land: 124 ha, and national infrastructure development land: 12,478 ha.
- For Son La province, the adjusted land use indicators by 2025 are as follows:
+ Agricultural land: 1,148,854 ha, including production forest land: 280,674 ha;
+ Non-agricultural land: 71,787 ha, including security land: 655 ha;
+ Unused land: 97,731 ha of land to be put to use, and the remaining unused land is 190,342 ha.
- For Hoa Binh province, the adjusted land use indicators by 2025 are as follows:
+ Industrial park land: 1,170 ha;
+ Security land: 414 ha;
+ National-level infrastructure development land: 28,395 ha, including transportation land: 9,780 ha, cultural facility construction land: 272 ha, healthcare facility construction land: 83 ha, education and training facility construction land: 830 ha, and energy infrastructure land: 10,916 ha.
