Adjustment of Road Works Maintenance Procedures During Operation and Use

Decree 37 regulates the adjustment of the road infrastructure maintenance procedure during exploitation and usage as follows:

- The owner or the manager/user has the right to adjust the maintenance procedure when detecting unreasonable factors that may affect the quality of the infrastructure, impacting the exploitation and use of the infrastructure;- The contractor who develops the maintenance procedure is obliged to amend, supplement, or change unreasonable content in the maintenance procedure if caused by their fault and has the right to refuse unreasonable requests for adjustment to the maintenance procedure from the owner or the manager/user of the infrastructure;- The owner or the manager/user has the right to hire another contractor with sufficient capacity to amend, supplement, and change the maintenance procedure in case the initial contractor who developed the maintenance procedure does not perform these tasks. The contractor who performs the amendments, supplements, and changes to the maintenance procedure is responsible for the quality of their work;- Infrastructure utilizing technical maintenance standards for maintenance must follow the revised or replaced standards whenever these standards are amended. The owner or the manager/user of the infrastructure is responsible for performing maintenance according to the revised content.
