Adjustment of Official Staffing: In What Cases Is It Considered?

This is a noteworthy provision in Decree 62/2020/ND-CP concerning job positions and official staffing.

According to Decree 62/2020/ND-CP, the adjustment of official staffing in agencies and organizations is considered in the following cases:

- Agencies and organizations have changes in one of the bases stipulated in Clause 2, Article 4 of this Decree;

- Establishment, reorganization, or dissolution of agencies and organizations as decided by the competent authority; establishment, dissolution, merger, division, or adjustment of the administrative boundaries of provincial or district-level administrative units.

Regarding the dossier and the procedure for adjusting official staffing

- The dossier for adjusting official staffing includes: a written proposal for the adjustment; a plan for adjusting official staffing; and related documents to adjust official staffing attached;

- For the adjustment to increase official staffing or transfer staffing between ministries, central authorities, and local authorities, the ministries, central authorities, and local authorities shall submit the dossier for adjusting official staffing to the Ministry of Home Affairs for appraisal and submission to the Prime Minister of the Government of Vietnam for decision;

- For the transfer of official staffing between ministries, central authorities, and local authorities and the agencies and organizations regulated in Clause 1, Article 21 of this Decree, the ministries, central authorities, and local authorities shall submit the dossier for the transfer of official staffing to the Ministry of Home Affairs for decision. The Ministry of Home Affairs shall aggregate and report to the Prime Minister of the Government of Vietnam when submitting the annual official staffing for approval.
