Article 36 Draft Law on Environmental Protection (amended) has supplemented regulations on preliminary environmental impact assessment in Vietnam as follows:

1. Subjects requiring preliminary environmental impact assessment

a) Public investment projects (including national important projects, Group A projects, Group B projects, Group C projects) with construction components, except for emergency public investment projects, projects under the national target program, and subprojects under projects which have had investment policies approved by competent authorities;

b) Construction investment projects not covered in point a of this clause which are approved for investment policies by the National Assembly, the Prime Minister of the Government of Vietnam, or the Chairman of the provincial People's Committee in accordance with the law on investment.

Thus, the Draft narrows the subjects requiring preliminary environmental impact assessment according to the Investment Law and the Public Investment Law as, in reality, only projects with construction components have an impact on the environment. It adds subjects as investment projects under the jurisdiction of provincial People's Committees; these regulations do not generate additional administrative procedures.
