Acts of trading positions or power by officials and public employees, party members include:
- Approaching, establishing relationships, bribing, enticing individuals who hold responsibility, positions, authority, or related individuals with the objective of obtaining a position, office, or benefits.
- Taking advantage of every occasion, especially during holidays, birthdays, and other opportunities, using personal or organizational titles, agencies, units, or other individuals to give gifts, money, property, organize recreational activities for leaders, authority figures, or related individuals to gain support, trust, and obtain a position, office, or benefits.
- Exploiting familiar relationships or using the advantages, work positions, reputation of others to influence, seek favor, or pressure those in authority or responsible for recommending, appointing oneself or others into positions or offices according to personal or group agendas.
- Using insider information or adverse information about the organization or individuals to set conditions, exert pressure on those in authority to recommend, nominate, or appoint oneself.
- Using one's background, family origin, work achievements to bargain, set conditions, or make unreasonable demands on organizations or individuals with authority and responsibilities to obtain positions, offices, or benefits.
- Employing other negative actions to achieve positions, offices, or benefits.
Acts of covering up, aiding in trading positions or power by officials and public employees, party members include:
- Knowing that personnel engages in trading positions, power but concealing, compromising, not handling according to authority, or not reporting to competent authorities for handling.
- Not handling according to specified authority or not reporting to competent authorities for handling upon receiving complaints, denunciations of personnel engaging in trading positions or power.
- Exploiting positions, authority, or using one's reputation, influence of oneself and family to suggest, influence, or pressure others to decide, advise, propose, assess, evaluate, vote to recommend personnel according to one's intent.
- Certifying, authenticating, evaluating falsely or forging, altering personnel records, election results, nomination votes, trust votes, examinations, benefiting personnel or achieving personal goals.
- Delaying, not implementing when seeing disadvantages or selecting advantageous timing for personnel to implement staff process according to one's intentions.
- Directly or indirectly accepting bribes to help others obtain undeserved positions, offices, or benefits.
- Directly or indirectly supporting, mediating for personnel to engage in trading positions or power mentioned in Article 10 of this Regulation.
- Other acts aiming to cover up, aid in trading positions, power.
Officials, party members, officials, and public employees engaging in trading positions or power or covering up, aiding such acts as mentioned above will be disciplined according to current regulations. Additionally, those who are currently working officials may face other handling measures depending on the form of discipline.
