This is an important content mentioned in Circular 130/2014/TT-BQP issued by the Minister of National Defense, guiding the implementation of certain articles of Decree 162/2013/ND-CP on sanctioning administrative violations in the territorial waters, islands, and continental shelf of the Socialist Republic of Vietnam.
According to the current legal provisions, acts infringing upon the sea areas, islands, and continental shelf of the Socialist Republic of Vietnam are understood as acts committed by foreign individuals or organizations using or operating vessels or other means in the sea areas, islands, and continental shelf of the Socialist Republic of Vietnam, but conducting serious violations of sovereignty, sovereign rights, and national jurisdiction at sea under Vietnamese law and international treaties to which Vietnam is a party.
To be specific:, Circular 130/2014/TT-BQP provides guidance on identifying acts infringing upon the sea areas, islands, and continental shelf of the Socialist Republic of Vietnam. To be specific:
- Acts infringing upon the sea areas, islands, and continental shelf of the Socialist Republic of Vietnam as stipulated in Clause 3 Article 8, Article 9, Article 11, Clause 6 Article 13 of Decree 162/2013/ND-CP are those committed by foreign individuals or organizations using or operating vessels or other means entering and conducting activities such as investigation, exploration, marine scientific research; tourism activities; exploitation, purchase, sale of aquatic products; construction, installation, and use of artificial islands, equipment, structures within the sea areas, islands, and continental shelf of the Socialist Republic of Vietnam without the permission of the State of the Socialist Republic of Vietnam.- For foreign individuals or organizations permitted by the State of the Socialist Republic of Vietnam to use or operate vessels or other means entering the sea areas, islands, and continental shelf of the Socialist Republic of Vietnam to conduct activities such as investigation, exploration, marine scientific research; tourism activities; exploitation, purchase, sale of aquatic products; activities related to artificial islands, equipment, structures that violate regulations, it is not considered an act infringing upon the sea areas, islands, and continental shelf of the Socialist Republic of Vietnam.
