On February 19, 2025, the National Assembly approved the Law on the Organization of Local Government 2025.

According to the provisions of Article 46 of the Law on the Organization of Local Government 2025, the activities of the People's Council when there are no longer two-thirds of the total number of People's Council deputies are as follows:

- In case the People's Council no longer has two-thirds of the total number of People's Council deputies elected according to the provisions of the Law on the Organization of Local Government 2025 and the remaining term exceeds 18 months, the supplementary election of People's Council deputies shall be carried out in accordance with the law on elections.

- In case the People's Council no longer has two-thirds of the total number of People's Council deputies elected according to the provisions of the Law on the Organization of Local Government 2025 and the remaining term is less than or equal to 18 months, the People's Council shall discuss and decide on the development plan for socio-economic, local budget, election, dismissal, relief of positions elected by the People's Council, the establishment, reorganization, dissolution of People's Council committees, specialized agencies under the People's Committee at the same level, urgent tasks within the duties and powers of the People's Council as prescribed by law.

When making decisions on the tasks specified in Clause 2, Article 46 of the Law on the Organization of Local Government 2025, it must be approved by more than two-thirds of the remaining People's Council deputies.

In case of a vacancy in the position of Chairman of the People's Council, the Standing Committee of the superior People's Council directly appoints the Acting Chairman of the People's Council; for provincial-level administrative units, the Standing Committee of the National Assembly appoints the Acting Chairman of the People's Council.

- The Chairman of the People's Council or Acting Chairman of the People's Council in the case specified in Clause 2, Article 46 of the Law on the Organization of Local Government 2025 shall perform the following duties and powers:

+ Coordinate with the People's Committee in preparing meetings of People's Council deputies; convene and preside over meetings of People's Council deputies to discuss and issue resolutions of the People's Council on the socio-economic development plan and local budget;

+ Summarize questions from People's Council deputies, opinions, and recommendations from voters to report to the meeting of People's Council deputies;

+ Maintain liaison, urge and facilitate the activities of People's Council deputies;

+ Convene and preside over the first session of the new term of the People's Council until the People's Council elects a Chairman of the People's Council;

+ Carry out other duties and powers of the Standing Committee of the People's Council as prescribed by law.

Note: The People's Council operates according to collective policies and decides by majority. The People's Committee at the local government level operates according to the collective policies of the People's Committee combined with emphasizing the responsibility of the Chairman of the People's Committee.
