Activities of supervision of the Standing Committee of the National Assembly for the People's Councils in Vietnam

According to law in Vietnam, the Standing Committee of the National Assembly (UBTVQH) supervises the activities of the People's Council to ensure that the People's Council performs its duties and exercises its powers as stipulated by the Constitution and the law, thereby enhancing the efficiency of the local State authority's operations.

According to the Ordinance on the supervision and guidance by the standing committee of the National Assembly, the guidance and inspection by the Government over the People's Councils 1996, this supervision is stipulated as follows:

- The Standing Committee of the National Assembly of Vietnam shall supervise sessions of the People's Councils, supervise the issuance of resolutions by the People's Councils, activities of the Standing Committees of the People's Councils, committees of the People's Councils, and deputies of the People's Councils.

- The Standing Committee of the National Assembly shall supervise the activities of the People's Councils through the following forms:

+ Reviewing the resolutions and reports of the People's Councils;

+ Attending sessions of the People's Councils;

+ Requesting the Chairperson of the People's Councils at all levels to report on issues of interest to the Standing Committee of the National Assembly;

+ Reviewing the settlement of complaints, denunciations, and petitions of organizations and citizens concerning the activities of the People's Councils and deputies of the People's Councils.

- The Ethnic Council, and the Committees of the National Assembly shall supervise the activities of the People's Councils in fields under the jurisdiction of the Ethnic Council and the Committees of the National Assembly, and carry out other supervisory tasks assigned by the Standing Committee of the National Assembly.

- The Standing Committee of the National Assembly on its own or at the proposal of the Prime Minister of the Government of Vietnam, the Head of the Supreme People's Procuracy, the Ethnic Council, the Committees of the National Assembly or deputies of the National Assembly shall review and decide to annul or request amendments to erroneous resolutions of the People's Councils of provinces and centrally administered cities.

- The Standing Committee of the National Assembly of Vietnam shall issue a resolution to dissolve the People's Councils of provinces and centrally administered cities in cases where the activities of those People's Councils cause serious harm to the interests of the people.

The Standing Committee of the National Assembly of Vietnam shall consult with the Government of Vietnam in approving the resolutions of the People's Councils of provinces and centrally administered cities regarding the dissolution of the People's Councils of districts, towns, district-level towns, and provincial cities.

- In case the People's Council in a locality is dissolved, the Standing Committee of the National Assembly shall determine and announce the election date for new deputies of the People's Council in that locality; the Prime Minister of the Government of Vietnam shall appoint the provisional People's Committee of provinces and centrally administered cities; the Chairman of the upper-level People's Committee shall appoint the provisional People's Committee at the subordinate level; the provisional People's Committees shall undertake the work until the new People's Councils and People's Committees are elected.
