The content is stipulated in Decree No. 34/2019/ND-CP amending and supplementing certain regulations on commune-level officials and non-specialized workers at the commune, village, and residential group levels.
regulations specified in Clause 2, Article 3 of Decree 34/2019/ND-CP have clearly stated the repeal of Article 9 of Decree 92/2009/ND-CP with the following provisions:
“Article 9. Allowances based on the type of commune
1. Commune officials specified in Clause 1, Article 5 of this Decree are entitled to allowances based on the type of administrative unit at the commune level calculated as a percentage of the current salary level, plus leadership position allowances, seniority allowances exceeding the frame, and reserved difference coefficients (if any); specifically as follows:
a) Level 1 commune officials enjoy an allowance of 10%;
b) Level 2 commune officials enjoy an allowance of 5%;
2. The allowances based on the type of administrative unit at the commune level mentioned in Clause 1 of this Article are not used to calculate, enjoy social insurance benefits, or health insurance.”
However, besides that, Decree 34/2019/ND-CP also stipulates an increase in the concurrent allowances for commune officials to 50% of the salary level 1 (previously 20% of the salary) plus the leadership position allowance (if any) of the concurrently held position, provided that the commune-level officials concurrently holding positions reduce 01 person from the maximum regulated number.
At the same time, the increase in allowances for some commune officials who are receiving a pension or loss of working capacity allowances includes receiving the pension or loss of working capacity allowances and additionally receiving a monthly allowance equal to 100% of the salary level 1 (previously 90% of the salary). In cases where, after a period of 05 years (60 months), if the assigned tasks are completed, and no discipline has been imposed during this time, they will enjoy 100% of the salary level 2 of the position held.
