A Form of Commendation That Can Be Awarded Multiple Times to One Recipient

This is one of the principles for commendation in the People's Court stipulated in Circular 01/2018/TT-TANDTC issued by the Supreme People's Court on April 24 [year not provided], to regulate the emulation and commendation work of the People's Court.

According to Circular 01, the principles of commendation within the People's Court are regulated as follows:

- Democratic, accurate, transparent, fair, and prompt.- One form of commendation can be awarded multiple times to the same individual or group; multiple forms of commendation are not awarded for the same achievement.- Within one year, no more than one form of state-level commendation is presented to an individual or group (for individuals, only one form of state-level commendation or the title "National Emulation Fighter" is proposed), except in cases of exceptional, sudden outstanding achievements, commendation for continuous contributions, or commendation based on seniority in the armed forces (if applicable).- Ensure consistency between the nature, form, and subject of the commendation.- Closely combine moral encouragement with material incentives.- Commendation must be based on achieved accomplishments. Achievements obtained under difficult conditions and with significant impact are given higher commendation. Only end-of-year achievement commendation results are used as the basis for consideration or recommendation for commendation (results from periodic or thematic emulation movements are recognized and prioritized during commendation or when proposing superior commendation). Accumulated achievements from previous commendations are not used to propose higher commendation levels later. Focus on commendation for small groups and individuals directly involved in labor, work, combat, and exhibiting innovation in these activities.- When considering commendation for heads of agencies or units, the collective achievements under that individual’s leadership must be the basis.- Commendation or recommendation for superior commendation is not considered for collectives or individuals currently under disciplinary review, investigation, audit, or inspection for violations, or with ongoing complaints or denunciations being clarified.- Collectives or individuals with annulled or revised judgments or decisions are not considered for commendation. However, if the appellate review concludes the annulment or revision was inaccurate, supplementary commendation will be considered.- No commendation consideration for collectives with officials and public employees or workers disciplined from a warning level or higher or under criminal indictment. Collectives with officials and public employees or workers receiving a reprimand can still be considered for commendation, but the emulation titles and commendation levels must be one rank lower than other collectives with similar achievements.- For female officials and managers, the duration in office for commendation consideration for continuous contributions is reduced by one-third (if retirement age policy is higher, duration in office for commendation follows general regulations).- When multiple individuals or groups qualify for a form of commendation, priority is given to females or groups with higher female ratios.- The time for proposing subsequent commendation is calculated based on the achievement date stated in the previous commendation decision. If the previous commendation decision does not indicate the achievement date, the proposal time for subsequent commendation is calculated based on the issuance date of the previous decision.- If calculating the number of individuals or groups results in a decimal, rounding is applied: below 0.5 is rounded to 0, 0.5 or above is rounded to 1.- The level that initiates periodic or thematic emulation movements assumes responsibility for commendation or proposing superior commendation (in cases of outstanding achievements with wider impact).
