To be appointed to the position of Bailiff and perform tasks related to civil judgment enforcement, document serving, creating record of events, ..., an individual must meet the standards outlined in the following article.
Before outlining the criteria, it is necessary to understand what a Thua phat lai is and the tasks they perform. Based on Decree 61/2009/ND-CP, we have the following definition of Thua phat lai:
"Thua phat lai is an individual appointed by the State to perform tasks related to civil judgment enforcement, serving of documents, generating written records, and other tasks as stipulated by the Decree and related laws."
To become a Thua phat lai, one must meet the following six criteria:
- Be a Vietnamese citizen, with good health and ethical qualities;- Have no criminal record;- Hold a bachelor's degree in law;- Have worked in the legal sector for more than 5 years or have been a Judge, Prosecutor, Lawyer, Enforcement Officer, Notary, Investigator at intermediate level or higher;- Possess a certificate of completion of the Thua phat lai training class organized by the Ministry of Justice;- Not concurrently practice as a Notary, Lawyer, or engage in other activities as prescribed by law.
Once the above criteria are met, an individual who wishes to become a Thua phat lai can prepare their dossier and follow the procedures stipulated to be appointed by the Minister of Justice as a Thua phat lai.
