6 Rights and obligations of media service users in Vietnam

This is the main content stipulated in Circular 05/2011/TT-BTTTT on Regulations on resolving complaints of service users in the information and communication sector issued by the Ministry of Information and Communications of Vietnam on January 28, 2011.

6 Rights and obligations of media service users in Vietnam (Illustration)

According to Article 3 of Circular 05/2011/TT-BTTTT, media service users in Vietnam have the following rights and obligations:

  1. To individually lodge complaints about errors directly related to the services provided by the service providers in the field of information and communication.

  2. To have the right to withdraw the complaint at any stage of the complaint resolution process. The withdrawal of the complaint must be made in writing.

  3. In case the service user is a minor, mentally ill, or suffering from other ailments that render them incapable of controlling their behavior, their legal representative will lodge the complaint; in case the complainant is sick, elderly, physically handicapped, or due to other objective reasons unable to lodge the complaint by themselves, they are authorized to their father, mother, spouse, siblings, adult children, or another person to lodge the complaint.

  4. To request the state management agency to guide the resolution of disputes when the service provider does not resolve it within the time limit specified in Article 11 of this Circular or does not agree with the complaint resolution result of the service provider.

  5. To have the right to submit a petition to the competent authority to resolve disputes as stipulated by the Law on Protection of Consumer Rights 2010.

  6. When exercising the right to complain, the complainant is obliged to provide related documents, evidence, and grounds for the complaint and must take responsibility for the content of the complaint, documents, evidence, and grounds they provide in accordance with the law in Vietnam.

More details can be found in Circular 05/2011/TT-BTTTT, which comes into effect in Vietnam from July 1, 2011.
