Regarding this issue, LawNet would like to answer as follows:
On October 27, 2023, the Ministry of Labor, War Invalids, and Social Affairs issued Official Dispatch 4594/LDTBXH-ATLD on the proposal for Lunar New Year and National Day holidays in 2024.
Based on the summary of opinions of relevant ministries and agencies (Attached summary table of opinions), the Ministry of Labor, War Invalids, and Social Affairs reports to the Prime Minister the plan for the Lunar New Year holiday in 2024 for officials, civil servants, public employees, and workers of administrative agencies, public service agencies, political organizations, and socio-political organizations (hereinafter referred to as civil servants and public employees) and employees in the business sector who are not civil servants or public employees (hereinafter referred to as employees) as follows:
(1) For civil servants and public employees
- Option 1: take 05 days off according to regulations, of which 02 days off before Tet and 03 days after Tet
Civil servants and public employees are on holiday for the 2024 Lunar New Year from Thursday, February 8, 2024 until Wednesday, February 14, 2024 (i.e. December 29, Quy Mao year to January 5, Giap Thin year).
So with this plan, civil servants and public employees will have 7 days off during the Lunar New Year holiday (including 05 days off for Lunar New Year and 02 days off to compensate for weekly holidays as prescribed in Clause 3, Article 111 of the Labor Code 2019).
- Option 2: take 05 days off according to regulations, including 01 day off before Tet and 04 days after Tet.
Civil servants and public employees are off for the 2024 Lunar New Year from Friday, February 9, 2024 until Thursday, February 15, 2024 (ie December 30, Quy Mao year to January 6, Giap Thin year).
So with this plan, civil servants and public employees will have 7 days off during the Lunar New Year holiday including 05 days off for Lunar New Year and 02 days off to compensate for weekly holidays as prescribed in Clause 3, Article 111 of the Labor Code 2019, and 02 days off weekly).
- Proposed plan: The Ministry of Labor, War Invalids, and Social Affairs proposes the Lunar New Year holiday according to plan 1.
Reason: Both options have the same number of days off, but option 1 ensures harmony in the time off before and after Tet (this option is unanimously agreed upon by all relevant ministries and agencies).
(2) For employees
Based on actual conditions and holiday schedules for civil servants and public employees, employers arrange Lunar New Year holidays for employees as follows:
(employers are encouraged to apply the Lunar New Year holiday period for employees as prescribed for civil servants and public employees):
- Choose 01 day before Tet, the first 04 days after Tet or 02 days before Tet and the first 3 days after Tet or 03 days before Tet and 02 days after Tet.
- Inform the Lunar New Year holiday plan at least 30 days before implementation.
If the weekly day off coincides with the Lunar New Year holiday, the employer shall arrange a compensatory weekly day off for the employee on the next working day as prescribed in Clause 3, Article 111 of the Labor Code 2019.
Regulations on holidays and Tet holidays for employees according to the Labor Code 2019 According to Clauses 1 and 2, Article 112 of the Labor Code 2019, employees shall be entitled to fully paid days off on the following public holidays: - Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar); - Lunar New Year Holidays: 05 days; - Victory Day: 01 day (the 30th of April of the Gregorian calendar); - International Labor Day: 01 day (the 1st of May of the Gregorian calendar); - National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day); - Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar). Foreign employees in Vietnam are entitled to 01 traditional public holiday and 01 National Day of their country, in addition to the public holidays. |
