2019: Cases Exempt from Participating in Military Service

The cases exempted from participating in military service are mentioned in Clause 2, Article 5 of Circular 140/2015/TT-BQP, including the following cases:

  1. Children of martyrs, children of first-class war invalids;

  2. One brother or sister of a martyr;

  3. One child of a second-class war invalid; one child of a sick soldier whose working capacity is reduced by 81% or more; one child of someone affected by Agent Orange whose working capacity is reduced by 81% or more;

  4. People engaged in cipher work who are not military personnel, People's Police;

  5. Officials and public employees, youth volunteers assigned to work in areas with especially difficult socio-economic conditions for 24 months or more as prescribed by law.

In addition, according to the provisions of Article 41 Law on Military Service 2015, the list of citizens eligible for exemption from conscription must be publicly posted at the headquarters of the commune-level People's Committees, agencies, and organizations for a period of 20 days.
