The article below will address the 18 rights of associations in Vietnam from November 26, 2024, in accordance with the new regulation of Decree 126/2024/ND-CP.

Article 23 of Decree 126/2024/ND-CP outlines 18 rights of the association in Vietnam from November 26, 2024:

(1) Organize and operate in accordance with the approved association’s charter.

(2) Propagate the mission and purpose of the association's activities. Be provided with information and disseminate the Party's directives and policies, as well as the State laws and regulations.

(3) Represent its members in domestic and international relations relevant to the association’s rights and obligations.

(4) Protect the legitimate rights and interests of the association, its members, and the community in line with the association's mission and objectives.

(5) Organize and coordinate activities among members for the common interests of the association.

(6) Disseminate and foster knowledge for members; provide necessary information to members as prescribed by law.

(7) Participate in programs, projects, scientific and technological research tasks, consultancy activities, and policy counterarguments at the request of state agencies; participate in providing public services, vocational training, and skills training as prescribed by law.

(8) An association operating nationwide or across provinces may establish branches or representative offices in other provinces or centrally governed cities apart from where its main office is located as stipulated in Clause 1, Article 25 of Decree 126/2024/ND-CP and can set up overseas representative offices.

(9) Form and strictly manage organizations under the association according to the law and the association's charter aligning with its mission, objectives, and field of operation.

(10) Participate in the development of mechanisms and policies directly related to the functions, duties, power, and operations of the association. Propose to competent state agencies on matters concerning the development of the association and the field it operates in.

Participate in organizing training, professional development, and other service activities as prescribed by law, and be awarded professional, competency, and other related certificates in the association’s field of activity when conditions as prescribed by law are met.

(11) Coordinate with relevant agencies and organizations to fulfill the association's tasks.

(12) Collect membership fees from members and engage in revenue-generating activities through business and service as prescribed by law to self-sustain financial resources.

(13) Receive, manage, and use lawful funding and aid from organizations and individuals, both domestic and foreign, in line with the association's mission, objectives, functions, and duties as prescribed by law.

(14) Be supported financially by the State for activities related to tasks assigned by the Party and the State (if any).

(15) An association operating nationwide or across provinces may join corresponding international organizations and sign and implement international agreements according to the law after obtaining consensus from competent authorities and other relevant state management agencies regarding the membership and implementation of international agreements.

(16) Award and discipline in accordance with the law and the association's charter.

(17) Mediate disputes, address, and resolve complaints, petitions, and denunciations related to the association.

(18) Other rights as prescribed by law.

According to Decree 126/2024/ND-CP, the association is a voluntary organization of Vietnamese organizations and citizens in the same field, profession, interest, gender, having a common goal of rallying and uniting members, operating regularly, not for profit. It aims to protect the legitimate rights and interests of the association, its members, and the community; support each other for effective operation, contributing to the economic and social development, and building and defending the Fatherland, organized, and operating according to Decree 126/2024/ND-CP and other related legislative documents in Vietnam;

Non-profit is understood as the association not seeking profit objectives. If profits arise during the association's activities, they are not distributed to members but are used only for activities per the association's charter approved by competent state agencies in Vietnam.

More details can be found in Decree 126/2024/ND-CP which comes into force in Vietnam from November 26, 2024.
